This chapter is adopted pursuant to general law and the Harbors and Navigation Code for the purpose of limiting the speed of motorboats and other vessels on part of the waters in the County. This chapter applies to both documented and undocumented vessels.

As used in this chapter, unless the context clearly requires a different meaning, all words have the same meanings as provided in Harbors and Navigation Code Section 651, including any amendments thereto subsequent to the enactment of this chapter.

No person shall operate any motorboat or other motor-powered vessel at a speed in excess of five miles per hour relative to the stream bottom for upstream speeds and relative to the water surface for downstream speeds on that part of the waters of the American River from the Interstate 80 bridge east to the Nimbus Dam; provided, however, that no motorboats shall operate on that portion of the American River which is closed to fishing during any given year by action of the California Fish and Game Commission because of the salmon spawning period. This prohibition against motorboats shall commence each year concurrently with the commencement of the fishing ban imposed by the California Fish and Game Commission and shall continue in effect until March 15th of each year.

No person shall operate any motorboat or other motor-powered vessel at a speed in excess of five miles per hour on that part of the water of Steamboat Slough from the confluence of Steamboat Slough and the Sacramento River to two thousand two hundred thirty-nine feet south of the confluence.

No person shall operate any motorboat or other powered vessel at a speed in excess of five miles per hour on that part of the waters of Sacramento River extending from the confluence of Georgiana Slough with the Sacramento River north to a point one thousand eight hundred feet from the north bank of the Delta Cross Channel. The north boundary is also identified as the north boundary of the community of Locke at the northern end of a building known as the Boat House.

This chapter does not apply in any area subject to the provisions of Harbors and Navigation Code Section 267 or in any other area for which a lesser speed limit is provided pursuant to the provisions of the Harbors and Navigation Code.

This chapter does not apply to any vessel being used by a peace officer of any federal, state or local agency while engaged in law enforcement activities for which the use of a motorboat is reasonably necessary, or vessels operated by the state or any agency thereof in the performance of official duties.
