The Board of Supervisors finds that the cost to the County of computer software, hardware and licensing to purchase, install, implement, operate and maintain the necessary automated permitting system to manage various licensing, permitting and property parcel information functions should be borne by the person who benefits from the automated permitting system. Therefore, the Board of Supervisors finds that a technology cost recovery fee ("TCRF") to cover the costs to purchase, install, implement, operate and maintain the automated permitting system shall be assessed on all persons requesting permits that utilize the automated permitting system.

This chapter shall apply to any and all County cases which use the automated permitting system. Notwithstanding the foregoing, this chapter shall not apply to deposits made to trust accounts for use towards future case fees, point of sale transactions, late fees or interest on delinquent accounts, and other similar transactions as determined by the Deputy County Executive, Community Services or designee.

The amount of the applicable TCRF shall be calculated according to the ordinance in effect at the time of the commencement of the case. The amount of the TCRF shall be six and one-half percent of the total amount of fees, penalties, or other charges assessed per automated permitting system case number, as determined by the Deputy County Executive, Community Services or designee, but shall not exceed eight hundred fifty dollars ($850.00). The Deputy County Executive, Community Services or designee may also determine to impose a lesser amount if it is determined that the full benefit of systems for which the TCRF is charged is not applicable to certain transactions.

Payment in full of the TCRF shall be required at the time all fees are due on any automated permitting case or upon completion of the case, whichever occurs earlier.

The Department of Finance is hereby directed to create in the County Treasury a special interest-bearing fund entitled Technology Cost Recovery Fee Fund or other appropriate accounting mechanism. All amounts collected from the TCRF shall be placed in said fund and expended by the Deputy County Executive, Community Services or designee solely to pay the costs of the purchase, installation, implementation, operation, and maintenance of the automated permitting computer system. The Deputy County Executive, Community Services or designee shall administer the Technology Cost Recovery Fee Fund.

As of June 30, 2027, this chapter shall be of no further force and effect and the collection of the TCRF shall cease unless extended by action of the Board of Supervisors.
