Division I of Title 12 of this code shall be known as and may be cited as the "Street Permit Ordinance."

Every person, except as otherwise provided in this Division I and Chapters 12.36 and 12.40 of this title, is required to obtain a permit from the city engineer before he:
A. 
Moves or causes to be moved over, along or across any street any load or vehicle;
B. 
Makes or causes to be made any excavation or encroachment in any street;
C. 
Places, changes or renews an encroachment;
D. 
Places, constructs or repairs any curb, gutter, sidewalk, driveway, pavement, base course, retaining wall, storm drain, culvert or other work of similar nature in, over, along, across or through any street;
E. 
Constructs, reconstructs or repairs any streetlight or street-lighting system in any street or in any privately owned thoroughfare which is open to public travel. This subsection E does not apply if any agreement with the city exists for the construction, reconstruction or maintenance of such installation;
F. 
Constructs, reconstructs, repairs or maintains any overhead structure or other appurtenant facility;
G. 
Places or leaves any impediment to travel upon any street.

Whenever a power is granted to or a duty is imposed upon a public officer, the power may be exercised or the duty may be performed by a deputy of the officer or by a person authorized, pursuant to law or ordinance, by the officer.

If any provision of this Division I and Chapters 12.36 and 12.40, or the application thereof to any person or circumstance, is held invalid, the remainder of this Division I and Chapters 12.36 and 12.40, and the application of such provisions to other persons or circumstances, shall not be affected thereby.

For the provisions of this Division I and Chapters 12.36 and 12.40, certain words and phrases are defined and certain provisions shall be construed as set forth in this chapter, unless it is apparent from the context a different meaning is intended.
A. 
The present tense includes the past and future tenses, and the future, the present.
B. 
The masculine gender includes the feminine.
C. 
The singular number includes the plural, and the plural the singular.
D. 
"Shall" is mandatory; "may" is permissive.

"Base course" means that portion of the street located between the pavement and the native soil.

"City" means the city of Pico Rivera.

"City engineer" means the city engineer of the city of Pico Rivera, or in his or her absence the director of public works of the city.

"Driveway" means that portion of the street right-of-way between the property line and curb, or between the property line and the pavement if no curb exists, where vehicles enter or leave the street onto adjacent property.

"Encroachment" means and includes any obstruction, tower, pole, pole line, pipe, fence, wire, cable, conduit, stand or building, or any structure or object of any kind or character not particularly mentioned in this Division I and Chapters 12.36 and 12.40 of this title, which is placed in, along, under, over or across the street. This definition does not apply to the temporary use of the street for ordinary maintenance of any existing authorized or permitted encroachment, nor to the suspension or stringing on existing pole lines of additional cables, wires, transmission lines, conduits or service connections solely for telephone or electric power purposes.

"Facilities or pipelines" means pipelines, valves, tanks, mains, service lines, conduits, duct banks, cables, wires, poles, tunnels, obstructions and other apparatus, both aerial and underground.

"Hazardous substance" means one having the potential for an immediate disaster, such as but not limited to gasoline, fuel oil, butane, propane, chemicals, natural gas or chlorine; and, for the purposes of this Division I and Chapters 12.36 and 12.40, electrical facilities shall comply with the requirements applicable to hazardous substances.

"Height" means that dimension, measured from the level surface upon which the vehicle stands, to the highest protrusion, in a vertical line.

"Load" means any object or thing which, when transported by a vehicle or combination of vehicles over, upon, along or across any street, would be required to have a special permit in accordance with provisions of the Vehicle Code, and includes but is not limited to any house, vessel, machine, equipment, transformer, tree, girder, boat or airplane.

"Moving contractor" means any person who, for himself or for another, moves or causes to be moved any load over, upon, along or across any street.

"Native soil" means the compacted native material.

"Newsrack" means any self-service or coin-operated box, container, storage unit or other dispenser installed, used or maintained for the display and sale of newspapers or news periodicals.

"One-call notification system" or "system" means an association providing for mutual receipt of notification of construction activities in the incorporated territory of the city of Pico Rivera.

"Overhead structure" means any structure, other than franchise utility poles and their facilities, extending over the dedicated portion of a street, including canopies, but excluding such projects from buildings as are enumerated in Chapter 15.04 of the Pico Rivera Municipal Code, and known as the Uniform Building Code.

"Pavement" means the surfaced portion of the street, which is composed of various size aggregates mixed with Portland cement and/or asphaltic compounds.

"Person" means and includes any individual, firm, copartnership, joint venture, association, corporation, estate, trust, business trust, any district, any city, including this city, and any county.

"Public" means any persons, as defined in this chapter, other than the city public works department, and includes the United States and this state.

"Roadway" means that portion of a street improved, designed or ordinarily used for vehicular travel.

"Street" means any public street, public way or public place in the incorporated area of the city, either owned by the city or dedicated to the public for the purpose of travel. The terms includes all or any part of the entire width of right-of-way, and above and below the same, whether or not such entire area is actually used for street purposes.

"Vehicle" means a vehicle or combination of vehicles, as described in the Vehicle Code, which:
A. 
Whether laden or unladen is required by the Vehicle Code to have a special permit to be on any street; or
B. 
Is so laden that it is required to have such special permit.

"Vehicle Code" means the state of California Vehicle Code in effect at the time of issuance of the permit.

"Width" means that dimension, measured at right angles to the anterior-posterior axis of the conveyance upon which the load or portion thereof is, or is to be, loaded or moved, or to the median line of the street over which the same is being or is to be moved.
