It is the purpose of these provisions to provide protection from fraud for the citizens of the City by requiring the registration of persons and organizations who desire to go door-to-door to residences for purposes of sales.

As used in this article (Residential Door-to-Door Solicitations), the following definitions shall apply:
Organization
includes a corporation (for profit or not for profit), business trust, estate, trust, partnership or association, or any other legal or commercial entity.
Person
is defined in Section 1.010 (Definitions and Rules of Construction).

Before commencing sales, any person or organization which desires to sell, distribute or take orders for merchandise or services by going door-to-door to residences, shall register as provided under Section 7.776 (Manner of Registration) and obtain a City business license as provided under Section 7.030 (Application for License).

The registration required by Section 7.774 shall be submitted to the Community Development Department on a form provided by the City and shall contain at least the following information:
A. 
The legal name, address and phone number of the organization or person registering.
B. 
The names, addresses and phone numbers of the officers and directors of the organization.
C. 
A description of the nature of the door-to-door sales proposed.
D. 
The specific dates and times during which the door-to-door activities are to be carried on and the areas to be covered.
E. 
The names, copy of a government-issued photo identification card, and cellular phone numbers of any and all persons who will be going door-to-door.
F. 
The name and address of the representative of the organization designated to receive notice from the City.
G. 
The name and business and cellular phone number of a contact person who will be in the area during all periods of sales. The contact person is responsible for the activities of all persons going door-to-door.

A. 
No person or organization shall sell door-to-door in violation of any Federal, State or City regulations or laws, such as ORS 646.611 (Telephone or Door to Door Seller; Information Required) or similar statute.
B. 
Persons or organizations selling in residential areas must provide each person going door-to-door with a copy of the approved City of Klamath Falls business license. Persons going door-to-door must show to potential customers the approved business license, along with government-issued photo identification.
C. 
Sales are permitted between the hours of 10:00 a.m. and 7:00 p.m. only.
D. 
This article (Residential Door-to-Door Solicitations) shall not apply to any constitutionally protected activity, including, but not limited to, religious and political solicitations.

The City Manager can revoke the authorization for door-to-door sales and business licenses for any violation of City, State or Federal law regulating door-to-door sales by the organization or person. If such a violation occurs within the City, the organization or person shall cease operation immediately and be subject to penalties as prescribed in Section 7.990 (Penalties).

If any section, subsection, sentence, clause or phrase of this article of this code is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of these sections. The Council hereby declares that it would have passed each section, subsection, sentence, clause, and phase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases may be declared invalid or unconstitutional, and, if for any reason any portion of this article should be declared invalid or unconstitutional, then the remainder of the ordinances shall be in full force and effect.
