It is hereby declared as the public policy of the City of Santa
Barbara that it is necessary to protect and safeguard the rights and
opportunities of persons with AIDS, ARC or HIV infection in respect
to discrimination in housing, business establishments, testing, access
to medical services and in City facilities and services. Therefore
discrimination or harassment based on HIV/AIDS is hereby incorporated
as discrimination based on disability and/or medical condition (as
those terms are defined by the California Fair Employment and Housing
Act — Government Code Section 12900-12996) under all City of
Santa Barbara non-discrimination policies, including, but not limited
to, provisions of the Santa Barbara Municipal Code, unless based on
a bona fide occupational qualification, or as otherwise provided in
Section 12940 of the Government Code.
