For the purpose of this Chapter, all words used in the present tense include the future tense. All words in the plural number include the singular number and all words in the singular number include the plural number, unless the natural construction of the word clearly indicates otherwise. The word “shall” is mandatory. The word “used” includes “designated, intended, built or arranged to be used.”

Unless a contrary intention clearly appears, the following words or phrases shall have, for the purposes of this Chapter, the meanings given below. Any word or term not defined herein shall be used with a meaning of the Yardley Borough Zoning Ordinance [Chapter 27], Building Code [Chapter 5, Part 1] and of standard usage.
ALTERATION
Any act or process specifically listed in this Chapter as a reviewable action, including without limitation the repair, replacement, reconstruction, demolition or relocation of any structure or object, or any part of a structure that is visible from the public way. Objects include, but are not limited to roofing, siding, porches, railings, doors, windows, storm windows and storm doors, fences, shutters, lighting fixtures, steps and ramps.
BOARD OF HISTORICAL ARCHITECTURAL REVIEW (HARB)
The agency that advises Borough Council and applicants for certificates of appropriateness.
BOROUGH COUNCIL
Governing body.
BUILDING
Any enclosed or open structure, which is a combination of materials to form a construction for occupancy and/or use for human or animal habitation and is permanently affixed to the land, including manufactured homes and sheds.
BUILDING INSPECTOR
An individual designated by the Borough as the individual who enforces compliance of building and/or fire codes and issues the permit for the erection, alteration, reconstruction, repair, restoration, demolition or razing of all or a part of any building or structure within a historic district.
BUILDING OR DEMOLITION PERMIT
A document signed by the Building Inspector, as required in the Building Construction Ordinance [Chapter 5, Part 1], authorizing the erection, construction, reconstruction, restoration, alteration, conversion, installation, demolition or razing of a structure or building.
CERTIFICATE OF APPROPRIATENESS
The approval statement signed by the Borough Council that certifies to the historical appropriateness of a particular request for the erection, alternation, reconstruction, restoration, demolition or razing of all or a part of any building, structure or permanent sign within a historic district and authorizes the issuance of a building, demolition, sign or zoning permit when applicable. Unless extended by the Borough, a certificate of appropriateness shall be valid for two years.
COMPLETED APPLICATION
A completed certificate of appropriateness application is an application, which conforms to the submittal criteria for specific historic preservation projects, as determined by the Historical Architectural Review Board and this Chapter. An application that does not conform to submittal criteria will be considered incomplete and will be returned to the applicant.
DEMOLITION
The dismantling or tearing down of all or part of any building and all operations incidental thereto, including neglecting routine maintenance and repairs that can lead to deterioration and decay.
DEMOLITION BY NEGLECT
The absence of routine maintenance and repair which can lead to a building’s or structure’s structural weakness, decay and deterioration resulting in its demolition.
ERECTION
The result of construction such as a building, structure, monument, sign or object on the ground or on a structure or building.
HISTORIC BUILDING INSPECTOR
A member of HARB designated to review applications for certificates of Appropriateness for completeness and to address building code issues before HARB. The Historic Building Inspector shall be an architect, builder, contractor or other professional or trades person familiar with building codes and the construction industry.
RECONSTRUCTION
The act or process of reproducing by new construction the exact form and detail of a vanished building, structure or object, or a part thereof, as it appeared at a specific period of time but not necessarily of original material.
SIGN
Any copy so constructed, placed, attached, painted, erected, fastened or manufactured in any manner whatsoever, which is used for the attraction of the public to any place, subject, person, firm, corporation, public performance, article or merchandise and is displayed in any manner whatsoever which can be seen from the right-of-way of a public street or highway, including permanent window signs placed inside windows to attract attention of those outside in the public right-of-way. Window displays, merchandise and temporary signs are excluded.
STRUCTURE
Anything constructed or erected, having a permanent or semi-permanent location on another structure or in the ground, including without limitation buildings, sheds, manufactured homes, garages, porches, steps, ramps, fences, gazebos, freestanding signs, billboards, antennas, satellite sending or receiving dishes, vending machines (including newspaper and ad boxes), decks and swimming pools.
ZONING OFFICER
A Borough employee or individual retained by the Borough and designated by the Borough as the individual who will enforce compliance with the certificate of appropriateness.
