The Board of Historical Architectural Review hereafter referred to as HARB shall be composed of seven members appointed by the Borough Council. One member shall be a registered architect, one member shall be a licensed real estate broker, one member shall be the appointed Historic Building Inspector, one member shall be a business owner in the Yardley Borough Historic District and three members shall be persons who have knowledge of and interest in the preservation of historic buildings and districts. The registered architect, licensed real estate broker, appointed Historic Building Inspector and business owner positions may be filled by qualified persons who reside outside of Yardley Borough; no more than three of these four positions may be filled at any one time by persons residing outside of Yardley Borough.

Terms of HARB members shall be four years. An appointment to fill a vacancy existing prior to the end of the term for which the member was appointed shall be only for the unexpired portion of the term.

There shall be no limit to the consecutive terms that can be served by members of HARB; however, any member may be removed for misconduct, for consistent absence from meetings or for other just cause, by a majority vote of all of the members of the Borough Council but not before the member is given the opportunity to be heard before Council. The position of any member of HARB appointed in his/her capacity as a registered architect, a licensed real estate broker, or as the Historic Building Inspector who ceases to be so employed shall be automatically considered vacant.

The members of the HARB shall serve without compensation, but may be reimbursed for direct expenses authorized by the Borough Council.

The HARB shall elect its own Chairman and Vice Chairman and create and fill such other offices as it may determine. Officers shall serve annual terms and may succeed themselves. The HARB may make and alter bylaws and rules and regulations to govern its procedures consistent with the ordinances of Yardley Borough and the laws of the Commonwealth of Pennsylvania, shall keep a full record of business and shall annually make a written report of its activities to the Borough Council. Interim reports may be made as often as may be necessary, or as required by the Borough Council.

HARB shall meet publicly at regularly scheduled intervals or, if there is no business to conduct, HARB may choose to delay meeting until such time that there are applications for review or other business to conduct. Further, HARB may hold any additional meetings it considers necessary to carry out its powers and duties indicated in this Chapter. Such additional meetings may be called by a majority of HARB members. All meetings shall be advertised and open to the public.

A majority of HARB shall constitute a quorum, and action taken at any meeting shall require the affirmative vote of a majority of the HARB members present.
4. 
A member shall upon determining he/she has a conflict relative to any matter brought before HARB, shall disqualify his/herself from participating, in any manner, publicly or privately, in the presentation, discussion or deliberation of and the voting on any such manner, including temporarily absenting themselves from the room in which the discussion is being held.

1. 
HARB shall:
A. 
Make recommendations to Borough Council regarding the advisability of issuing any certificate of appropriateness in accordance with the said Act of June 13, 1961, 53 P.S. §8001 et seq., as amended, and this Chapter.
B. 
Prepare and secure the approval from Borough Council for:
(1) 
Design and sign guidelines.
(2) 
Standards for unreasonable economic hardships.
C. 
Conduct a survey of exteriors of buildings, structures, objects and monuments for the purpose of determining those of historic and/or architectural significance and pertinent facts about them; and to maintain and periodically revise the detailed listings (resource inventories) of historic resources and data about them, appropriately classified with respect to National, State and local significance in accordance or consistent with the Pennsylvania Historical and Museum Commission’s “Cultural Resource Management in Pennsylvania; Guidelines for Historic Resource Surveys.”
D. 
Propose, from time to time as deemed appropriate, the establishment of additional historic districts and revisions to existing historic district with the approval of Borough Council.
E. 
Formulate recommendations concerning the establishment of an appropriate system of markers for selected historic and/or architectural site and buildings including proposals for the installation and care of such historic markers.
F. 
Formulate recommendations concerning the preparation and publication of maps, brochures and descriptive material about the Borough historical and/or architectural sites and buildings.
G. 
Cooperate with and advise Borough Council, the Borough agencies in matters involving historically and/or architecturally significant sites and buildings.
H. 
Cooperate with and enlist assistance from the National Park Service, the National Trust for Historic Preservation, Preservation Pennsylvania, the Pennsylvania Historical and Museum Commission and other agencies, public and private, from time to time, concerned with the preservation of historic sites and buildings.
I. 
Advise owners of historic buildings regarding rehabilitation, repairs, maintenance methods and technologies, adaptive use, grant opportunities and other historic preservation strategies.
J. 
Promote public interest in the purpose of this Chapter by carrying on educational and public relations programs.
