For the purpose of this chapter, "music teachers and tutors" are hereby defined as any person teaching or instructing, for hire, minors under the age of 18 in the homes of such minors, in the homes of such teachers or in any other location in the city.

Notwithstanding the definition in the preceding section, all certificated personnel under contract with a school district are excluded under such definition and from all regulations herein.

A. 
Required. It is unlawful for any person to engage in or carry on the business or profession of instructing minors under the age of 18 as set forth in the definition of Section 5.16.010, without first having secured a license from the city clerk so to do according to each and every requirement of this chapter, or without complying with each and every regulation contained herein.
B. 
Application. An applicant for a license herein shall submit his or her application to the chief of police, which application shall be under oath and shall include, upon appropriate forms to be furnished therefor, the past criminal record, if any, of the applicant, together with fingerprints, a photograph and physical description of the applicant, together with identity of all persons financially interested in the business or profession for which license is sought.
C. 
Investigation of Applicant. The chief of police shall forthwith investigate the past record, if any, of each applicant, together with all other matters essential to a judgment respecting the moral character of such applicant.
D. 
Denial—Appeal of Denial.
1. 
The chief of police shall deny any applicant for a license herein a license to operate if:
a. 
The applicant has previously been convicted of any narcotics violation, any felony or any crime involving moral turpitude.
b. 
The applicant is not, in the opinion of the chief of police, a person of good moral character.
2. 
The action of the chief of police in denying such a license on the basis of the applicant not being a person of good moral character shall be subject to an appeal to the city council. Notice of such an appeal shall be filed with the city clerk within 10 days after the denial of the license. Upon the failure to file such a notice within the 10-day period, the action of the chief of police in denying such license shall be final and conclusive.

Notwithstanding the foregoing, all music teachers and tutors, as described in Section 5.16.010, who have been in such business or profession for more than one year in the city prior to July 6, 1965, shall have 30 days after such date within which to comply with this chapter.
