A city pound is hereby created. Such pound shall be located and provided for as shall be specified from time to time by the city council by resolution. The pound shall be under the supervision and control of the poundmaster.

A. 
Position Created—Supervision, Etc. The position of poundmaster is hereby created. The poundmaster shall serve under the supervision and direction of the chief of police.
B. 
Appointment—Term—Compensation. The poundmaster shall be appointed by the city council. Terms of employment and compensation of the poundmaster shall be fixed by the council.
C. 
Duties Generally. The duties of the poundmaster shall be as provided in this chapter or as required by other provisions of this Code or state law. The poundmaster shall have the authority to issue a notice to appear to the owners, possessors or custodians of animals which are in violation of this Code or state law. In addition to other duties, the poundmaster shall impound any stock or estray animal in the city and hold the same pursuant to the provision of Article 2 of the Agricultural Code of this state.

Any animal found in violation of this chapter and impounded by the poundmaster shall be tattooed or shall have a permanent identification implant applied by the poundmaster prior to being released to the owner or other person seeking release of said animal. Each tattoo or permanent identification implant shall be registered in the name of the owner with a national registry as permanent identification. Such registration shall include the owner's name, address, telephone number, animal's name, if any, a description sufficient to readily identify the animal and the place where the tattoo or identification implant was applied. The city council shall by resolution establish a reasonable fee sufficient to offset the cost of applying the tattoo or identification implant which fee shall be paid by the owner or other person seeking release of the animal to the poundmaster at the time of release of the animal.

The violation of any provision of this chapter shall be subject to an administrative civil penalty in accordance with the procedure set forth in Chapter 2.28 of the Oroville Municipal Code.

It is unlawful for any person to abandon any dog or other animal at any place within the city.
