A. 
The Los Angeles County Fire Code is hereby adopted by reference, except as hereinafter provided, that certain Fire Code as adopted by Ordinance No. 23-0008 of the County of Los Angeles, entitled "Fire Code, County of Los Angeles, 2023."
B. 
The Fire Code is based on both the adopted sections of the 2022 California Fire Code and unadopted sections of the California Fire Code found in the 2021 International Fire Code. The following sections of the California Fire Code and International Fire Code are adopted by reference:
C. 
Except as hereinafter changed and modified, Chapters 1 through 80; and Appendix B, Appendix BB, Appendix C, Appendix CC, of the 2022 Edition of the California Fire Code, including errata and supplements, published by the California Building Standards Commission, and Chapters 1 through 7, Chapters 9 and 10, Chapters 20 through 37, Chapters 39 and 40, Chapters 50 and 51, Chapters 53 through 56, Chapters 57 through 67, Chapter 80, Chapters 81 through 83, and Appendix O, PP, QQ, and Appendix R of the 2021 Edition of the International Fire Code, published by the International Code Council, for sections that were not adopted as part of the 2022 California Fire Code are hereby adopted by reference and incorporated into this Title 32 of the Los Angeles County Code as if set forth fully below, and, as amended to include Chapters 81 through 83 and Appendices O, P, and Q, shall be known as Chapters 1 through 83, Appendix B, Appendix BB, Appendix C, Appendix CC, Appendix D, Appendix N, Appendix O, Appendix P and Appendix Q of Title 32 of the Los Angeles County Code.
D. 
Copies of Ordinance No. 23-0008 of the County shall be at all times maintained by the Building Official for use and examination to the public.
E. 
In the event of any conflict or ambiguity between any provisions contained in the Building Code and any provisions of the Walnut Municipal Code, the Walnut Municipal Code shall control.

Ordinance No. 23-0008 of the County, as hereinabove adopted as the Fire Code of the City, is amended as follows:
A. 
Whenever in the ordinance reference is made to the unincorporated area of the County of Los Angeles, such area shall be deemed to include in its true geographical location the area of the City.
B. 
Whenever any of the following names or terms are used in Ordinance 23-0008, each such name or term shall be deemed and construed to have the meaning ascribed to it in this section as follows:
1. 
County of Los Angeles. The City of Walnut, except in such instances where the County of Los Angeles is a correct notation due to circumstances.
2. 
County official of the County of Los Angeles. The applicable City official of the City of Walnut.

The Los Angeles County Fire Code adopted by Section 3.16.010 is hereby amended as follows:
A. 
Title 32 Fire Code, Section 5601.1.3 "Fireworks."
The manufacture of fireworks within the jurisdictional area is prohibited except under special permits as are required by local and state regulations.
Exceptions:
1. 
Permits for Public Displays. Except as hereinafter provided, it shall be unlawful for any person to possess, store, to offer for sale, expose for sale, sell at retail or use or explode any fireworks, including safe and sane fireworks, provided that the chief shall have power to adopt reasonable rules and regulations for the granting of permits for supervised public displays of fireworks by a jurisdiction, fair associations, amusement parks, other organizations or for the use of fireworks by artisans in pursuit of their trade. Every such use or display shall be handled by a competent operator approved by the chief and shall be of such character and so located, discharged, or fired so as, in the opinion of the chief after proper investigation, not to be hazardous to property or endanger any person.
a. 
Applications. Applications for permits shall be made in writing at least 10 days in advance of the date of the display. After such privilege shall be granted, sale, possession, use and distribution of fireworks for such display shall be lawful for that purpose only. No permit granted hereunder shall be transferable.
b. 
Bond for Firework Display. The permittee shall furnish a bond or certificate of insurance in an amount deemed adequate by the chief for the payment of all damages which may be caused either to a person or persons or to property by reason of the permitted display and arising from any acts of the permittee, his or her agents, employees, or subcontractors.
c. 
Disposal of Unfired Fireworks. Any fireworks that remain unfired after the display is concluded shall be immediately disposed of in a way safe for the particular type of fireworks remaining.
2. 
Nothing in this article shall be construed to prohibit the use of fireworks by railroads or other transportation agencies for signal purposes of illumination, or the sale or use of blank cartridges for a show or theater, or for signal or ceremonial purposes in athletics or sports or for use by military organizations.
B. 
Title 32 Fire Code, Section 5601.7 "Seizure of Fireworks" is amended as follows:
The chief shall seize, take, remove, or cause to be removed at the expense of the owner all stocks of fireworks offered or exposed for sale, stored, or held in violation of this article.
C. 
Title 32 Fire Code, Section 325.10 "Roadway Clearance" is amended as follows:
The chief or commissioner may require removal and clearance of all flammable vegetation or other combustible growth for a minimum of 10 feet on each side of every roadway, whether public or private, or any fence constructed of combustible materials. The chief or commissioner may enter upon private property to remove and clear vegetation and growth as required by this section and may charge the responsible party for the cost of such action. This section shall not apply to single specimens of trees, ornamental shrubbery or cultivated ground cover such as green grass, ivy, succulents, or similar plants used as ground covers, provided that they do not form a means of readily transmitting fire. As used in this section, "roadway" means that portion of a highway or private street improved, designed or ordinarily used for vehicular travel. The minimum clearance of 10 feet may be increased if the fire chief determines additional distance is required to provide reasonable fire safety.

All provisions of this chapter shall be carried out and enforced in conjunction with the law enforcement agency of the City, by the Los Angeles County Fire Department, and the Consolidated Fire Protection District. The general supervision of conditions and equipment which aid in control of fire, conditions constituting fire hazards or danger to life or property and the abatement or minimizing of such fire hazards or dangerous conditions shall be the responsibility of the Los Angeles County Fire Department and the Consolidated Fire Protection District.
