A. 
A contractor permit, a paid political circulator permit, or a volunteer political circulator permit may be denied, or revoked by the city clerk for conviction of perjury, or for conviction as a party to a crime the basis of which is submitting or offering false or fraudulent documents, or for a violation of the California Elections Code related to the signing or circulation of a petition. A contractor permit or paid political circulator permit may be denied or revoked for any other reason provided by law.
B. 
Failure to maintain the records required by this chapter, or failure to allow review of those records by a duly authorized representative of the city clerk or a peace officer in the conduct of official business or an investigation, during normal business hours, upon a reasonable demand taking into consideration the time, place and circumstances present at the time of the demand, shall be deemed grounds to permit revocation of a contractor permit in accordance with this chapter.
C. 
Any action to deny or revoke a permit as provided in this section shall be reviewed by the chief administrative officer (or designee) and a determination shall be made within 60 days of the receipt of the application or knowledge of the conviction, whichever is applicable, or the action shall be withdrawn. The chief administrative officer may accept written evidence in mitigation.
D. 
The applicant or permit holder shall be advised in writing by the city clerk, mailed within seven working days, of the decision to act against the issuing of the permit or the decision to proceed towards revocation of an existing permit. If the permit is to be revoked, this notice shall contain a statement that the decision may be challenged judicially under California Code of Civil Procedure Section 1085.

A. 
For the first violation, every person who acts as a paid political circulator or as a volunteer political circulator in violation of this chapter is guilty of an infraction in accordance with Chapter 1.16 of this code.
B. 
For the second and subsequent violation, every person who acts as a paid political circulator or volunteer political circulator in violation of this chapter is guilty of a misdemeanor in accordance with Chapter 1.16 of this code.
C. 
For the third and subsequent violation, every person who acts as a contractor (including recordkeeping and inspection requirements) in violation of this chapter is guilty of a misdemeanor in accordance with Chapter 1.16 of this code.
