The words and phrases set forth below shall be defined, for
the purposes of this chapter, as follows:
"Films"
means and includes still pictures, video tapes and/or motion
pictures.
"Owner"
means the owner or operator of a picture arcade.
"Picture arcade"
means a use located on a lot in the city:
1.
Where there is maintained one or more machines, devices or contrivances
which show films; and
2.
That a fee, tip or other compensation is required as a condition
precedent for any person to view the films; and
3.
A "picture arcade" shall include an "adult picture arcade," as that term is described in Chapter
17.56 of this code.
The definitions set forth in Title 17 of this code, including, without limitation, the provisions of Chapter 17.56, shall apply to this chapter.

No person shall operate or conduct, or permit the conduct, or
operation of a picture arcade, except in compliance with the provisions
of this code, including this chapter, and the city's zoning code.

The owner of a picture arcade shall comply with the following
regulations:
A. Manager.
Each picture arcade shall have a responsible person over the age of
18 years, authorized and acting as its manager on the premises at
all times during which the picture arcade is open for business.
B. Hours
of Operation. The owner of a picture arcade may operate the same only
between the hours of eight a.m. and ten p.m. of any day.
C. Visibility
from Exterior. No portion of the interior of the picture arcade shall
be visible from the outside of the building in which it is located.
D. Visibility
from Interior. The owner of a picture arcade shall maintain the picture
arcade so that:
1. The
entire interior of the building wherein the picture arcade is located,
except for restrooms, is visible immediately upon entrance to such
building or portion thereof where the picture arcade is located; and
2. That
the entire body of any person viewing the films is also visible immediately
upon entrance to such building, or portion thereof where the picture
arcade is located.
E. Lighting.
A picture arcade shall be maintained in its entirety, at all times
during its hours of operation, with a minimum of one footcandle illumination
generally distributed in all parts of the picture arcade.
F. Examination
of Films by Owner. The owner of each picture arcade shall examine
and view each of the films offered for viewing prior to showing or
displaying the same to patrons.
G. Inspection
Requirements. The owner of a picture arcade shall not permit any doors
in the building where the picture arcade is located, to be locked
during business hours; and, in addition, the owner shall be responsible
to ensure that any room or area occupied by such picture arcade shall
be readily accessible at all times and shall be open to view in its
entirety for inspection by any police officer or any city code enforcement
officer.
H. Age
Restrictions. No person under 18 years of age shall:
1. Be
employed, for any purpose, in a picture arcade; and
2. Be
or remain in, enter or visit any picture arcade unless such minor
is accompanied at all times by his or her parent, guardian or spouse
who is over 21 years of age.
I. Use
of Alcohol or Drugs Prohibited. The owner of each picture arcade shall
not permit any person to be in or remain in any part of the building
where the picture arcade is located while in the possession of, and/or
under the influence of any alcoholic beverage or prohibited controlled
substance.
