The city council of the city is the sole legislative body of
the city.

The general municipal election for the city shall be held on
the first Tuesday after the first Monday in November of each even-numbered
year.

A. Purpose.
The purpose of this section is to provide the city council with several
options, if feasible and economically viable, to be decided by a majority
vote of the council, to fill an elected vacancy, such as council member.
B. If a
vacancy occurs at an elected position, other than by expiration of
term, the council shall, at its option, within sixty days from the
commencement of the vacancy, either fill the vacancy by appointment
or call a special election to fill the vacancy. The special election
may be held on the next regularly established election date, or as
set forth in California
Elections Code Sections 4004 and 1500 (e.g.,
mail-in ballot), but at any rate shall not be less than one hundred
fourteen days from the call of the special election. A person elected
to fill a vacancy holds office for the unexpired term of the former
incumbent. A person appointed to fill a vacancy holds office pursuant
to one of the following:
1. If
the vacancy occurs in the first half of a term of office and at least
one hundred thirty days prior to the next general municipal election,
the person appointed to fill the vacancy shall hold office until the
next general municipal election that is scheduled one hundred thirty
or more days after the date the council is notified of the vacancy,
and thereafter until the person who is elected at that election to
fill the vacancy has been qualified. The person elected to fill the
vacancy shall hold office for the unexpired balance of the term of
office.
2. If
the vacancy occurs in the first half of a term of office, but less
than one hundred thirty days prior to the next general municipal election,
or if the vacancy occurs in the second half of a term of office, the
person appointed to fill the vacancy shall hold office for the unexpired
term of the former incumbent.
C. Notwithstanding
any other provision of this section, an appointment shall not be made
to fill a vacancy on the city council if the appointment would result
in a majority of the members serving on the council having been appointed.
The vacancy shall be filled in one of the following ways:
1. The city council may call an election to fill the vacancy to be held pursuant to subsection
B of this section.
2. If the city council does not call an election pursuant to subsection
B of this section, the vacancy shall be filled at the next regularly established election date.

A. Time
and Place. The time of regularly scheduled meetings of the city council
of the city and the location for holding same shall be provided for
by city council resolution, from time to time amended as necessary.
All official meetings of the city council shall be held within the
boundaries of the territory over which the city exercises jurisdiction,
except when otherwise provided for by law.
B. Legal
or National Holidays. In the event the day fixed for any regular meeting
of the city council falls upon a day designated by law as a legal
or national holiday, such regular meeting shall be held at the same
hour and place on the next succeeding business day.

A. Any
items to be brought before the city council at a regular or adjourned
regular meeting shall be placed on the council agenda. Items not placed
on the council agenda may not be taken up by the city council until
the next regular meeting except as is expressly provided for by law.
B. To have
an item placed on the council agenda, the nature of the item along
with any information that is desired to be presented to the city council
shall be presented to the city clerk's or city manager's office by
the end of the tenth business day preceding the council meeting.
