A. All
officers and employees of the city authorized or required to issue
permits or licenses, shall conform to the provisions of this article
and shall issue no permit or license for uses, buildings or purposes
in conflict with such provisions. Any such permit or license shall
be null or void.
B. The
building official shall not issue any building permit for the construction
of any building, structure, facility or alteration, the construction
of which, or the proposed use of which, would constitute a violation
of the provisions of this article.

It shall be the duty of the community development director to
enforce the provisions of this article pertaining to the erection,
construction, reconstruction, moving, conversion or alteration of
buildings and structures.

A. Any
building or structure set up, erected, constructed, altered, enlarged,
converted, moved, or maintained contrary to the provisions of this
article, and any use of any land, building, or premises established,
conducted, operated or maintained contrary to the provisions of this
article is declared to be unlawful and a public nuisance.
B. It
shall be unlawful and a public nuisance for any person to offer for
sale or to sell units, shares, or other interests in condominiums,
stock cooperatives, or community apartments without first applying
for and receiving the applicable permit.
C. The
city attorney, with the approval of the city manager, shall immediately
commence action or proceedings for the abatement, removal, or enjoinment
of anything declared to be a public nuisance pursuant to this article
in the manner prescribed by law. The city attorney shall take such
other steps and shall apply to such courts as may have jurisdiction
to grant such relief as will abate and remove such building or structure,
and restrain and enjoin any person, firm, or corporation from setting
up, erecting, building, maintaining or using any such building or
structure contrary to the provisions of this article, or selling or
offering to sell units, shares, or other interests in condominiums,
stock cooperatives, or community apartments contrary to the provisions
of this article.
D. The
remedies provided for in this section shall be cumulative and not
exclusive.
