The places of amusement set forth in this section shall be subject to, and be governed by, the regulatory laws of the City. No license required by the provisions of Chapter 1 of Title
3 of this Code shall be granted for the following amusements unless the application for such license is accompanied by a permit in writing granted by the Council:
(a) Billiard
rooms and pool halls;
(b) Carnivals
and other similar exhibitions;
(c) Circuses
and other similar exhibitions, including side shows conducted in conjunction
therewith and parades conducted by or under the same management as
a circus or similar exhibition where such circus or similar exhibition
is conducted outside the City;
(d) Golf
courses, miniature golf courses, bicycle courses, golf practice driving
courses, and archery ranges;
(e) Juke
boxes, devices for playing records or producing music automatically
upon the deposit of a coin, slug, or other device, and other instruments
and machines of like character operated on business premises;
(f) Riding
academies where instruction in horseback riding is given or horses
or other animals are maintained for hire;
(g) Shooting
galleries, public bowling, skee ball, and bat ball alleys, hand ball
courts, shuffleboards, and other similar devices, equipment, or means
of entertainment;
(h) Roller
skating and ice skating rinks, enclosures, and parks; provided, however,
exhibitions given in restaurants, cafes, hotels, and theaters where
the public is not permitted to participate in the exhibition shall
be excluded from the provisions of this subsection;
(i) Theaters
at established places of business constructed and designed for theatrical
purposes;
(j) Lectures
or traveling theatrical performances under, surrounded by, or partially
enclosed by canvas, such as comedy, spoken drama, opera, and concerts;
and
(k) Trained
animal shows for which an admission fee is charged or a collection
is taken.
