A.
1. Any
person violating any of the provisions or failing to comply with any
of the mandatory requirements of the ordinances of the city shall
be guilty of a misdemeanor; provided, however, that the city attorney
shall have the discretion to elect to charge such violation of any
provision of this code as an infraction.
2. Each
person shall be guilty of a separate offense for each and every day
during any portion of which any violation of any provision of this
code is committed, continued or permitted by such person and shall
be punishable accordingly.
3. Except
in cases where a different punishment is prescribed by any ordinance
of the city, any person convicted of a misdemeanor under the provision
of this code shall be punishable by a fine of not more than $1,000
or imprisonment in the San Joaquin County Jail for a period of not
more than six months, or by both such fine and imprisonment, for each
offense.
4. Any
person convicted of an infraction for violation of an ordinance of
the city under this code shall be punishable by a fine of not more
than $500 for each offense.
B. In addition
to the penalties hereinabove, any condition caused or permitted to
exist in violation of any of the provisions of this code is deemed
a public nuisance and may be, by this city, summarily abated; and
each day such condition continues shall be regarded as a new and separate
offense.
