Pursuant to the provisions of California Vehicle Code Section 22507, the city council may prohibit the parking of vehicles on certain streets and/or highways located within the city. The streets and/or highways upon which parking is prohibited shall be designated by resolution adopted by the city council.

Any officer of the police department or regularly employed or salaried employee who is engaged in enforcing parking laws and regulations of the city may remove or cause to be removed a vehicle in accordance with the provisions of the California Vehicle Code and the following:
A. 
Any vehicle that has been parked or left standing upon a street or alley for 72 or more consecutive hours;
B. 
Any vehicle which is parked or left standing upon a street when such parking or standing is prohibited by ordinance or resolution and signs are posted giving notice or removal;
C. 
Any vehicle which is parked or left standing upon a street where the use of such street or any portion thereof is necessary for the cleaning, repair or construction of the street or for the installation of underground utilities, or where the use of the street or any portion thereof is necessary for the movement of equipment, tractors or structures of unusual size, and the parking of such vehicle would prohibit or interfere with such use or movement; provided, that signs giving notice that such vehicle may be removed are erected or placed at least 24 hours prior to the removal;
D. 
Any vehicle, trailer or semi-trailer parked upon any street, alley, public way or public place in any industrial or commercial district that is not attached to a motor vehicle capable of providing the motive power for moving the vehicle, trailer or semi-trailer upon the street, alley, public way or public place.

Upon amendment by ordinance prohibiting parking on certain streets and/or highways within the corporate limits of the city, as depicted below, the director of public works is directed to place appropriate signs and/or markings sufficient to give adequate notice of such no parking areas. Until appropriate signs and/or markings sufficient to give adequate notice of such no parking areas, as depicted below, is provided by the director of public works, no enforcement of the provisions of this section shall occur.

Pursuant to provisions of California Vehicle Code Section 22507 and Section 10.24.010 of this chapter, it shall be unlawful for the operator of any vehicle to stop, stand, park or leave standing such vehicle at any time (except when in compliance with the direction of a police officer or other authorized officer) in any area designated by the city council as a no parking zone and appropriate signs and/or markings have been placed.

It shall be unlawful for any person to park any commercial vehicle having a manufacturer's gross vehicle weight rating of 10,000 pounds or more on any street or highway or portion thereof in a residential district.

No person who owns, has possession, custody or control of any vehicle shall park such vehicle upon any street or public right-of-way for more than a consecutive period of 72 hours.

No person who owns, has possession, custody or control of any vehicle shall park such vehicle upon any street or public right-of-way under the following conditions:
A. 
Where the use of highway or a portion thereof is necessary for the cleaning, repair or construction of the highway or for the installation of underground utilities, and signs giving notice that such vehicle may be removed are erected or placed at least 24 hours prior to the removal;
B. 
Where the use of the highway or any portion thereof is authorized for a purpose other than the normal flow of traffic; or for the movement of equipment, articles or structures of unusual size; and the parking of such vehicle would prohibit or interfere with such use or movement, and signs giving notice that such vehicle may be removed, are erected or placed at least 24 hours prior to the removal;
C. 
Where any vehicle is parked or left standing when such parking or standing has been prohibited by ordinance or resolution of the city and such place is indicated by appropriate signs or by red paint upon the curb surface;
D. 
Where any vehicle is parked or left standing within a roundabout or traffic circle.

No person who owns, has possession, custody or control of any vehicle shall park such vehicle within an alley in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for free movement of vehicular traffic, and no person shall stop, stand, or park a vehicle within an alley in such position as to block the driveway entrance to any abutting property.

No person who owns, has possession, custody or control of any vehicle shall park such vehicle which is six feet or more in height, including any load thereon, within 100 feet of any intersection so designated in the traffic resolution.

No person who owns, has possession, custody or control of any vehicle shall park such vehicle in such a position as to obstruct the normal movement of traffic or within the roadway as defined by a painted edgeline.

A. 
No person who owns, has possession, custody or control of any trailer or any semi-trailer shall park such trailer or semi-trailer upon any street, alley, public way or public place, unless such trailer or semi-trailer, at such times it is so parked, is attached to a motor vehicle capable of providing the motive power for moving the trailer or semi-trailer upon the street, alley, public way or public place.
B. 
This section shall not prohibit the parking of a trailer or semi-trailer in the process of being loaded or unloaded, nor of a trailer or semi-trailer which is disabled in such a manner and to such an extent that it requires some vehicle or facility other than its normal means of motivation to move the same along such street, alley, public way or public place; provided, however, such trailer or semi-trailer so disabled may remain so parked while unattached to the motor vehicle described in this section only for the time necessary for the vehicle or facility to be provided for its removal, and in no event longer than two hours.
C. 
Recreational vehicles such as travel trailers, motorhomes, marine vessels, all-terrain vehicles, and similar vehicles can park on the street no longer than 48 hours for the purpose of loading, unloading, cleaning, and preparation before or after use.

No person shall park or place upon any roadway, city easement, city sidewalk, or any public property any vehicle or vessel displaying any sign, picture, transparency, advertisement or mechanical device for the purpose of advertising or bringing notice to any person the fact that such vehicle or vessel is to be sold, rented or leased; nor shall any person park or place upon any roadway, city easement, city sidewalk or public property, or private property any vehicle for the purpose of calling the attention of the general public to any business or to commodities being sold, rented, raffled, or given away by other than a charitable or nonprofit organization.
A. 
The provisions of this section shall not apply to vehicles parked for sale on the private property of the owner of said vehicle and the public streets immediately adjacent thereto.
B. 
In any case, advertising signs on vehicles parked for sale shall not be more than 10 inches by 12 inches and shall include the name, address and telephone number of the seller.
C. 
The provisions of this section shall not apply to vehicles parked on the private property of a duly authorized and licensed vehicle dealer as permitted elsewhere in this code.

Notwithstanding the foregoing, no parking restrictions shall apply to authorized emergency vehicles, as that term is defined in California Vehicle Code Section 165, or to any other equipment designated by the chief of police or designee as being exempt from the provision of this chapter.

No person shall interfere with or obstruct in any way any police officer or other officer or employee of this city in their enforcement of the provisions of this chapter. The removal, obliteration or concealment of any chalk mark or other distinguishing mark used by any police officer or other employee or officer of this city in connection with the enforcement of the parking regulations of this chapter shall, if done for the purpose of evading the provisions of this title, constitute such interference or obstruction.

Pursuant to California Vehicle Code Section 40203.5, the following parking penalties are established by ordinance or resolution by the city council:
A. 
Lathrop Municipal Code: Chapter 10.24.
B. 
California Vehicle Code: A violation of any California Vehicle Code section shall be punishable at the rate of $55 per violation unless otherwise specified. A violation of California Vehicle Code Section 22500(l) or California Vehicle Code Section 22507.8 shall be punishable at the rate of $285 for each violation.
C. 
Any person, firm, or corporation violating any of the provisions of Section 10.24.150 shall be deemed guilty of a misdemeanor, and upon conviction thereof; shall be punishable as provided in Section 1.16.010.
D. 
A violation of any other parking control or restriction not otherwise contained in this chapter shall be punishable at the rate of $55 per violation unless otherwise specified.
E. 
Two types of payment plans are available for payment of parking fines.
1. 
Indigent Payment Plan. If approved, a five-dollar fee will be added to the citation and all late charges and penalty assessments excluding state surcharges will be waived, contingent upon providing proof of indigence. Community service is not offered as an option, in lieu of payment. Acceptable proof of indigence shall be one of the following:
a. 
Supplementation of Social Security/State Supplementary Payment. Provide a copy of two most recent benefit check stubs or statements and certification from county Social Services office.
b. 
CalWORKS/Tribal TANF. Provide a copy of Golden State Advantage Card (EBT).
c. 
SNAP. Provide a copy of Golden State Advantage Card (EBT).
d. 
County Relief/General Relief/General Assistance, CAPI. Provide a copy of County Service Office Verification.
e. 
IHSS and Medi-Cal. Provide a copy of Medi-Cal Card.
f. 
Income 125% Federal Poverty Level (FPL). Provide a copy of last income tax forms, paystub and bank statement showing income.
2. 
Non-Indigent Payment Plan. If approved for a non-indigent payment plan, a twenty-five dollar ($25.00) fee will be added to the citation. Individuals seeking to place their parking citation on a payment plan, exclusive of indigence status are not required to submit supporting documentation. Community service is not offered as an option, in lieu of payment.
