The purpose of this article is to provide for an orderly transition
from the present town government of Mt. Crested Butte to a new government
under the provisions of this Charter. The provisions of this article
shall constitute a part of this Charter only to the extent necessary
to accomplish that purpose.
This Charter shall become effective immediately upon voter approval
except that those provisions of Article IX relating to the preparation
and submission of the budget and capital program shall become effective
for the 1975 annual budget, and those provisions in Article III relating
to the election of councilmember shall become effective at the organizational
election scheduled under this Charter to be held in November of 1976.
All bylaws, ordinances, resolutions, rules and regulations of
the town which are not inconsistent with this Charter and which are
in force and effect at the effective date of this Charter shall continue
in full force and effect until repealed or amended. Those provisions
or any effective bylaw, ordinance, resolution, rule or regulation
which is inconsistent with this Charter is hereby repealed.
Upon the passage of this Charter by the voters, the present
board of trustees and the present mayor of the town shall become councilmen
and shall serve in that position until their successors are duly qualified
after the organizational election to be held in November of 1976.
All boards and commissions in existence at the time of adoption
of this Charter shall continue to function under the provisions of
this Charter.
Except as otherwise provided herein, after the effective date
of this Charter, all appointive officers and all employees of the
town shall continue in that town office or employment, which corresponds
to the town office or employment which they held prior to the effective
date of this Charter, as though they had been appointed or employed
in the manner provided in this Charter and they shall in all respects
be subject to the provisions of this Charter, except that any officer
or employee who holds a position which this Charter provides be held
at the pleasure of the appointing officer or body, shall hold such
position only at such pleasure regardless of the term for which originally
appointed.
This Charter shall not affect any suit pending in any court
or any document heretofore executed in connection herewith. Nothing
in this Charter shall invalidate any existing contracts between the
town and individuals, corporations or public agencies.
