In order to recruit and retain the best qualified persons available for service with the City of Mill Valley and to promote and increase economy and efficiency in the service of the City, a personnel system is adopted pursuant to the provisions of Title 4, Division 5, Chapter 1 of the Government Code of the State of California.

The personnel system established by this chapter shall apply to all offices, employments and positions in the City government, including officers and employees of the Mill Valley public library; provided, however, that the personnel system shall not apply to any offices, employments and positions which are by state law exempt therefrom.

A. 
The City Manager shall formulate and submit to the City Council personnel rules and revisions and amendments to such rules, a position classification plan and a plan of compensation covering all classifications in the personnel system.
B. 
Any plan, rule or amendments submitted by the City Manager shall have legal effect as part of this Municipal Code when it is approved by the Council by resolution.
C. 
The City Manager may, with the consent of the City Council, obtain on behalf of the City any of the following services from persons and agencies skilled in personnel administration:
1. 
The preparation of personnel rules and subsequent revisions and amendments;
2. 
The preparation and revision of the position classification plan;
3. 
The preparation and revision of a pay plan;
4. 
The preparation, conduct and grading of competitive examinations;
5. 
Special and technical services of advisory or informational character on matters relating to personnel administration.

Any period of time during which an employee covered by the personnel system is required to be absent from his or her position by reason of an injury or disease for which he or she is entitled to receive compensation under the provisions of Division 4 (commencing with Section 3201) of the Labor Code is not a break in his or her continuous service for the purpose of his or her right to salary adjustments, sick leave, vacation, or seniority.

When an employee covered by the personnel system submits a voluntary written resignation from city employment effective on a subsequent date, said voluntary resignation may not thereafter be withdrawn without the consent of the City Manager.
