The City Council of the City of Mill Valley makes the following findings:
A. 
The City has heretofore adopted a pension plan providing for retirement and death benefits for employees of the City of Mill Valley. The pension plan is provided for in Chapter 2.44 of the Mill Valley Municipal Code;
B. 
A substantial number of employees of the City have requested that the City contract with the Public Employees' Retirement System so as to substitute the benefits provided by the Public Employees' Retirement System for the benefits heretofore provided under Chapter 2.44 of the Mill Valley Municipal Code;
C. 
The City Council is willing to enter into such a contract with the Public Employees' Retirement System provided that persons employed on the contract date who wish to avail themselves of the benefits provided by the Public Employees' Retirement System shall first file a waiver of their rights under the pension plan created by Chapter 2.44 of the Mill Valley Municipal Code.

Any and all persons employed by the City on the date of a contract to be entered into between the City of Mill Valley and the Public Employees' Retirement System who desire to avail themselves of the benefits to be provided by the Public Employees' Retirement System shall prior to the contract date, file with the City of Mill Valley a waiver of their rights under the pension plan created by Chapter 2.44 of the Mill Valley Municipal Code. Such waivers shall become effective and shall terminate the rights of the persons signing such waivers under the pension plan created by Chapter 2.44 of the Mill Valley Municipal Code, upon the effective date of the contract between the City and the Public Employees' Retirement System.
