It shall be unlawful for any person, firm or corporation to remove, deface, alter, injure or destroy any surveyors' monuments or marks placed or erected in any of the public streets, avenues, alleys or highways of the City of Mill Valley, or any other marks or monuments placed in any of the public streets, avenues, alleys or highways of the City by the City Engineer of said City or by the City Council of said City, or under the direction of said City Council of said City, for the purpose of marking, delineating or indicating any grade or official grade of any street, avenue, alley, lane, sidewalk or public highway of the City of Mill Valley or any sewer or other public work of said City; provided, however, that where the removal of any such mark or monument is or becomes necessary in the opening of any public street, avenue, alley, lane, sidewalk or highway of said City, for the laying of any main pipe or sewer therein, the person, firm or corporation so opening such street and removing such monument or mark must immediately upon the completion of such work restore such monument to its original location and position under the direction of the City Engineer of said City, at its own cost and expense.
