As used in this chapter, the term "athletic race" shall mean any running, walking or bicycling competition over a set course, any portion of which lies within the City of Mill Valley, which involves 50 or more participants and which is publicly announced through advertisements, posters, circulars, or in any other manner.
It shall be unlawful for any persons to conduct or participate in conducting any athletic race within the City of Mill Valley without first obtaining a permit to do so from the Mill Valley Parks and Recreation Commission. Application for race permits must be submitted no later than 90 days before the race date and no earlier than one calendar year prior to the race date. The application shall be on a form prescribed by the Mill Valley Parks and Recreation Department.
In granting or denying any such application, the Mill Valley Parks and Recreation Commission shall consider, among other things, the following:
A. 
Whether the conduct of the race will substantially interrupt the safe and orderly movement of other traffic contiguous to its route.
B. 
Whether the conduct of the race will require the diversion of so great a number of police officers of the City to properly police the line of movement and the area contiguous thereto as to prevent normal police protection to the City.
C. 
Whether the conduct of the race will unduly interfere with the movement of fire, police, ambulance and other emergency vehicles.
D. 
Whether the conduct of the race will unduly interfere with access to residences and business establishments contiguous to its route.

The Mill Valley Parks and Recreation Department, in cooperation with the Mill Valley Public Safety Department, shall establish the direct and administrative costs of City supervision for each athletic race. A fee equal to these costs shall be paid by each permittee. In addition, the Mill Valley Parks and Recreation Commission shall, by resolution, establish a fee schedule for athletic races based upon the number of participants and whether the race commences, finishes or merely passes through the City of Mill Valley. Upon the issuance of a permit, a deposit shall be paid by the permittee in accordance with the established fee schedule and the estimate of the City's direct and administrative costs. If the actual direct and administrative costs incurred by the City exceed the amount deposited therefor, the permittee shall pay the excess to the City at the conclusion of the race. If the actual amount of direct and administrative costs incurred by the City is less than the amount deposited therefor, the excess shall be returned to the permittee upon conclusion of the race.

Before any athletic race permit is issued, the permittee shall provide evidence satisfactory to the City of insurance coverage in amounts to be established by the Parks and Recreation Commission naming the City of Mill Valley, its officers, agents and employees as additional insured.
