It is unlawful for any person to offer to sell, to contract to sell, or to sell any subdivision or any part thereof, until a final map in full compliance with the provisions of this title and the Subdivision Map Act of California, has been duly recorded or filed in the office of the County Recorder.
It shall also be unlawful for any person to offer to sell, to contract to sell, or to sell any subdivision or any part thereof, until all of the provisions of Chapter 21.28 have been complied with.

Nothing herein contained shall be deemed to bar any legal, equitable, or summary remedy to which the City of Mill Valley or other political subdivision, or any person, firm, corporation, partnership, or co-partnership may otherwise be entitled, and the City or any other political subdivision or person, firm, corporation, partnership or co-partnership may file a suit in the Superior Court of the County of Marin to restrain or enjoin any attempted or proposed subdivision or sale in violation of this title.

Any conveyance, sale or contract to sell, made contrary to the provisions of this title is voidable at the option of the grantee, buyer or person contracting to purchase, his or her heirs, personal representative, or trustee in insolvency or bankruptcy within one year after the date of the execution of the deed of conveyance, sale or contract of sale.

Any person owning real property may request, and the City shall determine whether such real property complies with the Subdivision Map Act and with the provisions of this title. Upon making such a determination the City shall cause a certificate of compliance to be filed for record with the Recorder of the County of Marin.

Requests for a certificate of compliance shall be made to the Department of Planning and Building on a form prescribed by the Director of Planning and Building and shall be accompanied by a fee in an amount fixed by resolution to be adopted by the City Council.
