An arts commission is created and established. The arts commission may be known and referred to, among other things, as the "Malibu arts commission" or "arts commission."

The cultural arts commission shall consist of five members who shall be residents of the city. Members shall not be officers or employees of the city. The city council may appoint one ex officio member who lives outside the city limits but within the 90265 zip code area. The ex officio member shall not have a vote on the commission and may not serve as either chair or vice chair of the commission. An ex officio member is appointed at large by the city council.

Following an interview process, each member of the city council shall appoint one member of the cultural arts commission to serve at the pleasure of the appointing councilmember. Appointments shall be made at a regular city council meeting.

Each member of the cultural arts commission shall serve a four-year term. Commissioners shall be appointed at a regular city council meeting following the general municipal election at which the appointing councilmember was elected. In the event the office of any appointing councilmember becomes vacant during the term thereof, the term of the commissioner appointed by such councilmember shall terminate 90 days after such vacancy occurs. Following expiration of the term of office, each commissioner shall continue to serve until his or her successor is appointed and qualified. Notwithstanding any provision of this code, each commissioner shall serve at the pleasure of the appointing councilmember and may be removed by that councilmember at a regular city council meeting.

Vacancies on the cultural arts commission shall be filled by appointment by the individual councilmember who made the appointment to the seat which is vacant.

If a member of the cultural arts commission is absent from three successive regular meetings without being excused by the commission, or is absent for any reason for more than six regular meetings in any 12 month period, the office of such member shall be deemed vacated and the chair shall immediately notify the city manager, who shall notify the city council that the office is vacant. A successor for the remainder of the term of such member shall be appointed as provided in Section 2.26.030.

Regular meeting days of the cultural arts commission shall be determined by resolution of the cultural arts commission, except that the commission's regular meeting shall be at least once monthly.

The cultural arts commission may make recommendations to the city council with respect to matters concerning the cultural arts policy, facility rental fee policies for local cultural arts organizations, cultural arts related general fund grant applications, use of city parks for cultural arts-related events, purchase of art by the city, cultural arts programs sponsored by the city, outreach to Malibu artists and cultural arts organizations, use of cultural spaces at Malibu City Hall, and such other matters as directed by the city council.

Accurate and permanent records of the actions of the commission shall be kept, and such records shall have the same status as records of other administrative departments of the city.

The cultural arts commission shall elect one of its members to serve as chair. Such election shall be held at least annually on a date set by resolution of the commission. The chair serves at the pleasure of the commission. The commission may adopt such rules and regulations as it deems necessary to provide for its other officers and their method of selection, and for other matters relative to its work and administration. Minutes, resolutions and official records of the commission shall be filed with the city clerk.

Members of the cultural arts commission may receive compensation for their services as set by resolution of the city council. The parks and recreation director or designee shall submit to the finance officer at the end of each calendar month, a statement showing the number of meetings of the cultural arts commission attended by each member during the month. No additional compensation shall be paid for expenses incurred by the members of the commission in the performance of their duties, except that the city council may from time to time authorize in advance, expenditures for attendance at seminars, institutes, or other meetings which the city council finds to be beneficial to the commissioners in the performance of their duties, and in the best interest of the city. Claims for such expenses shall be filed with the finance officer and shall be subject to audit and approval by the city council.
