Division 1 of Title 11 of the Los Angeles County Code (the health code), as amended and in effect on March 1, 1998, is adopted by reference as the health code of the city of Malibu.
A copy of Division 1 of Title 11 has been deposited in the office of the city clerk, and shall be at all times maintained by the clerk for use and examination by the public.

Division 1 of Title 8 of the Los Angeles County Code (public health licensing), as amended and in effect on June 10, 2016, is adopted by reference as the public health licensing regulations of the city of Malibu, subject to the amendments set forth in the following sections.
A copy of Division 1 of Title 8 has been deposited in the office of the city clerk of the city of Malibu and shall be at all times maintained by the clerk for use and examination by the public.

Notwithstanding the provisions of Section 8.04.020 of this chapter, subsection A of Section 8.04.752 of Chapter 8.04 of Division 1 of Title 8 of the Los Angeles County Code is amended to read as follows:
A. 
The health officer shall post at such inspected food facility the Letter Grade Card, the Inspection Score Card, or both, as determined by the health officer, so as to be clearly visible to the general public and to patrons entering the food facility. "Clearly visible to the general public and to patrons" shall mean posted in the following order of priority:
1. 
Posted in the front window of the food facility within five feet of the front door. If such posting is not reasonably possible in the determination of the health officer, then posted shall occur as provided in subsection 2, below.
2. 
Posted in a display case mounted on the outside front wall of the food facility within five feet of the front door. If such posting is not reasonably possible in the determination of the health officer, then posting shall occur as provided in subsection 4, below.
3. 
If the food facility is a mobile food facility, then the Letter Grade Card, the Inspection Score Card, or both must be posted adjacent to the pass out window, or on the customer service side of an unenclosed mobile food facility. If such posting is not reasonably possible in the determination of the health officer, then posting shall occur as provided in subsection 4, below.
4. 
Posted in such location as directed and determined in the discretion of the health officer to ensure the most effective notice to the general public and to patrons.

In the event of conflicts between the provisions of the health code adopted by Sections 8.04.010 and 8.04.020. and any other provision of the Malibu Municipal Code, the provisions of the Malibu Municipal Code shall prevail.

A. 
In addition to any criminal, civil or other legal remedy established by law that may be pursued to address violations of the municipal code, violations of any provision of this chapter or the code or regulations adopted by this chapter are subject to the administrative penalty provisions of Chapter 1.10.
B. 
Civil Remedies Available. The violation of any of the provisions of this chapter or the code or regulations adopted by this chapter shall constitute a nuisance and may be abated by the city through civil process by means of restraining order, preliminary or permanent injunction or in any other manner provided by law for the abatement of such nuisances.
