The city establishes a communications utility.

A. 
The communications utility will operate within the city under the administrative authority of the manager.
B. 
The communications utility will comply with all city regulations on similar utilities, including the requirements of Hillsboro Municipal Code Chapter 9.48.
C. 
Revenues and expenditures of the communications utility will be accounted for within the communications fund of the city budget.

A. 
The communications utility may provide any communications services as defined in Hillsboro Municipal Code Section 9.48.020 and any similar services as directed by the council. The utility may provide communications services to any customer in any lawful manner, including, but not limited to, providing services to end users or providing third parties with access to city-owned communications infrastructure to enable the provision of communications services.
B. 
The communications utility may provide services inside or outside the city limits to the extent consistent with applicable laws.
C. 
The council will by resolution establish rates for residential and businesses services. The manager will establish rates and charges for deposits, late fees and penalties, and other specialized services for which the council has not established rates. Rates for out of city customers may include a component representing a return on capital investment by the city.
