As used in this article, the following terms shall have the meanings indicated:
PARKLET
A platform, similar level surface, or other encroachment on or extending into the City right-of-way (such as a sidewalk or parking space), designated as public space, with amenities such as but not limited to tables, chairs, benches, plants, bike parking, umbrellas, canopies, and related appurtenances.
SIDEWALK CAFE
An outdoor dining area, located on a sidewalk area or other City right-of-way, where food is purchased and served in individual portions for consumption on the premises, and which has amenities such as but not limited to tables, chairs, benches, plants, umbrellas, canopies, serving stations, and related appurtenances.

A. 
Permit required. It shall be unlawful for any person to operate a sidewalk cafe or parklet without a permit from the Bureau of Code Enforcement.
B. 
Permit application. Application for such permit shall include, but need not be limited to:
(1) 
Plans on how the applicant will delineate their area of operation on the City right-of-way;
(2) 
Agreement to keep the premises free of any rubbish and debris at all times;
(3) 
Agreement that the applicant is and will remain current on all City taxes and fees, and acknowledgement that the permit may be revoked upon delinquency of any payment;
(4) 
Agreement that such sidewalk cafe or parklet shall not encroach on the minimum pedestrian walkway and shall comply with the Americans with Disabilities Act ("ADA"), 42 U.S.C. § 12101 et seq. as established by the Bureau of Code Enforcement; and for sidewalk cafe permits, agreement that a full-time employee will supervise the operation of the sidewalk cafe during its hours of operation.
C. 
Noncompliance. The Bureau of Code Enforcement may revoke, suspend, or refuse to issue a permit, or take any other enforcement action authorized by law, in the event of a person's noncompliance with this article or its implementing rules and regulations.

The Bureau of Code Enforcement will require that a reasonable fee of $25 be paid with each sidewalk cafe permit application or parklet permit application.

The Bureau of Code Enforcement may establish and promulgate rules, regulations, and forms in furtherance of this article.
The City shall reserve the right to direct that any or all furniture, appurtenances, or other encroachments be removed from the City's right-of-way in the event of traffic problem, utility work, disorder, public safety, emergency, or other reasonable basis.
