This chapter shall apply to all parking facilities, held open to the public within the city.
As used in this chapter "parking facility held open to the public" means any off-street facility, or a discernible portion thereof, held open for use by the public for parking vehicles and includes any publicly or privately owned facilities for off-street parking where no fee is charged for the privilege to park, and which are held open for the common public use of retail customers, business patrons, or visitor parking.

A. 
The owners of parking facilities, as described in Section 10.30.010, shall designate and mark handicapped or disabled (as defined by Vehicle Code Section 22511.5) parking spaces:
1. 
By outlining or painting the stall or space in blue and outlining on the ground in the stall or space in white or suitable contrasting color a profile view depicting a wheelchair with occupant; and
2. 
By posting immediately adjacent to, and visible from, each stall or space, a sign consisting of a profile view of a wheelchair with occupant in white on a blue background.
B. 
The number, size, location, and all other features of the handicapped space(s), including signs and pavement markings, shall conform to the provisions of Title 24 of the California Administrative Code.

A. 
Parking facilities constructed prior to April 14, 1989, and which, but for the provisions of this chapter would be conforming, are declared lawful nonconforming uses.
B. 
All lawful nonconforming parking facilities shall be made to conform to this chapter upon the occurrence of one or more of the following:
1. 
Within eighteen months from the effective date of adoption of this chapter;
2. 
Upon processing of a building permit on the property pursuant to Section 12.12.030 of this code;
3. 
Upon any occasion that the property owner initiates any change requiring a review of an approved development plan on the property.
C. 
Property owners shall be permitted to encroach into required open space areas or to reduce the number of standard parking spaces as necessary, to provide parking spaces with the proper dimensions for handicapped parking.

All parking facilities which are not made to conform to the provisions of this chapter by November 1, 1990, may be declared a nuisance, and shall be caused to conform after notice and an opportunity to request a hearing has been provided. The city shall enforce violations of this chapter pursuant to the provisions of Chapter 15.18 of this code.

Violation of any provision of this chapter shall be a misdemeanor for each day such violation continues. All violations of this chapter shall be subject to civil penalties in accordance with Chapter 1.24 of this code.
