A. 
An applicant for a full package liquor license shall be in compliance with all provisions of the State of Missouri Liquor Control Law, this Chapter of the Overland City Code and upon approval by the City Council may be issued a license giving the licensee the right to sell intoxication liquor or malt liquor as defined in this Chapter.
B. 
Full Package Liquor License Requirements. No full package liquor license for the sale of intoxicating liquor in the original package not to be consumed upon the premises where sold ("Class A," subclasses A-C, A-F and A-S) shall be issued except to a person engaged in and to be used in connection with the operation of one (1) or more of the following businesses: a convenience store or a supermarket as defined herein, including neighborhood markets; nor shall any person engaged in the above named occupations be given a license for original package goods sales as herein defined who does not have and continuously keep in his/her store a stock of goods having a value according to invoices of at least one thousand dollars($1,000.00), exclusive of fixtures and intoxicating liquors. Any other package liquor license other than a full package liquor license obtained by a licensee is not subject to the requirements in this Section.

A. 
Notwithstanding any other provisions of this Chapter to the contrary, any person possessing the qualifications and meeting the requirements of this Chapter, who is licensed to sell intoxicating liquor in the original package at retail under this Chapter, may apply to the City for a special permit to conduct wine, malt beverage, and distilled spirit tastings on the licensed premises. This license shall be described as a "Class I" license. A licensee under this Section shall pay to the City an additional thirty-seven dollars fifty cents ($37.50) a year payable at the same time and manner as other license fees. Class I licenses shall be subject to the approval of the City Council.
B. 
Nothing in this Section shall be construed to permit the licensee to sell wine, malt beverages or distilled spirits for on-premises consumption, except for consumption under a Verona Pavilion Event Permit, wherein the premises for such license shall be limited to Verona Pavilion.
C. 
Notwithstanding the other provisions of this Chapter, a permit for the tasting or sale of malt liquor as defined in Section 311.200, RSMo., for the consumption on the premises where it is sold outside of otherwise licensed premises may be issued to any church, school, civic, service, fraternal, veteran, political, or charitable club or organization for the tasting and sale of such malt liquor at a picnic, bazaar, fair, or other similar gathering, provided that such applicant shall meet the requirements for a liquor license as described in Chapter 600 and the Missouri Liquor Control Act. Such a permit shall be described as a "special event permit." A special event permit shall be effective for a period not to exceed one hundred sixty-eight (168) consecutive hours and shall authorize the service of alcoholic beverages at such special event during the hours at which alcoholic beverages may lawfully be sold or served upon premises licensed to sell alcoholic beverages for on-premises consumption. An application for such special event permit shall be made to the City Clerk at least twenty-five (25) business days prior to the proposed special event. All special event permit applications shall be subject to the approval of the City Council by motion or resolution. The fee for such special event permit shall be thirty-seven dollars fifty cents ($37.50).
D. 
A subset of special event permit shall allow for a permit for the tasting or sale of malt liquor as defined in Section 311.200, RSMo., for the consumption and limited whole package sale during special events held at the Verona Pavilion may be issued to an applicant who meets the requirements for a liquor license as described in Chapter 600 and the Missouri Liquor Control Act, subject to the limitations described herein. Such permit shall be described as a "Verona Pavilion Event Permit." A Verona Pavilion event permit shall authorize the permittee to: 1) sell malt liquor by the drink to patrons of a Verona Pavilion event; and 2) shall also authorize the sale of retailer-packaged alcoholic beverages to customers in containers, filled on such premises by any employee of the retailer, subject to the requirements and in accordance with Section 311.202, RSMo. Such retailer-package alcoholic beverages for consumption off-site shall not to exceed two packages of four sixteen-ounce cans [or a total of 128 fluid ounces] per patron purchasing retailer-packaged alcoholic beverage, so long as such retailer-packaged alcoholic beverage is also manufactured by the permittee/retailer. A Verona Pavilion event permit shall be limited to one (1) permittee per Verona Pavilion event. A Verona Pavilion event permit shall be effective for a period of twelve (12) consecutive hours and shall authorize the service and sale of alcoholic beverages at such Verona Pavilion event during the hours at which alcoholic beverages may lawfully be sold or served upon licensed premises licensed to sell alcoholic beverages for on-premises consumption. An application for such Verona Pavilion event permit shall be made to the City Clerk at least twenty-five (25) business days prior to such Verona Pavilion event and shall be reviewed on a first-come, first-served basis. All Verona Pavilion event permit applications shall be subject to the approval of the City Council by motion or resolution. Such application shall also include the consent of the organization or entity holding the Verona Pavilion event. The fee for such Verona Pavilion event permit shall be thirty-seven dollars fifty cents ($37.50).

An applicant for a full by-the-drink liquor license shall be in compliance with all provisions of the State of Missouri Liquor Control Law, this Chapter of the Overland City Code, and upon approval by the City Council may be issued a license giving the licensee the right to sell intoxicating liquor, malt liquor, and/or non-intoxicating beer as defined in this Chapter, provided that the licensee shall obey the following restrictions:

City Council may require consent of local residents. For every license issued or renewal of license for the sale of intoxicating liquor of alcoholic content in excess of five percent (5%) by weight at retail, by-the-drink for consumption on the premises of the licensee the City Council may require any applicant for a license to sell liquor as classified in this Chapter to secure written consent of a majority of the resident property owners within two hundred (200) feet of the property lines on the same street of such applicant's place of business before granting such license.
2. 
Number of tavern licenses to be limited. The City Council shall be limited to the issuance of licenses as provided in this Section on a population basis of one (1) license to each seventeen hundred (1,700) resident inhabitants of the City, as such population is determined by the last preceding United States Census population count. No license shall be granted in anticipation of population, other than herein determined. This limitation shall apply only to the number of licenses for taverns issued pursuant to this Section as defined in Section 600.010 and will not apply to those licensees who are considered under the law to be non-profit organizations and restaurant bars as defined in Section 600.010 of this Chapter. Total number of licenses for non-profit organizations as defined by law will be mandated by Subsection (3) of this Section. Any other by the drink liquor license other than a full by the drink liquor license obtained by a licensee is not subject to the requirements in this Section.
3. 
Number of non-profit organization liquor licenses to be limited. The City Council shall not issue more than six (6) full by-the-drink liquor licenses to non-profit organizations as defined in Section 600.010 of this Chapter.
