(1) Except
for Ordinance No. 5862 adopted by the city of Springfield on September
15, 1997 the Springfield Code adopted in 1965, as subsequently amended,
is hereby repealed.
(2) The
provisions of the document marked and designated as the “Springfield
Municipal Code” (hereinafter referred to as “code”)
are hereby enacted as a general and permanent law of the city of Springfield.
(3) The
adoption of Ordinance No. 5862 is hereby reaffirmed and it shall be
incorporated into the Springfield Municipal Code, and the section
numbers as set forth in the ordinance adjusted to conform to the section
number system set forth in the code.

The provisions of the code adopted in section
1.000 are the laws of the city of Springfield and not merely prima facie evidence of the law.

The provisions of this code adopted in section
1.000 take effect at 10:30 a.m. on November 18, 1997.
[Section 1.005 amended by Ordinance No. 5866 enacted November 17, 1997]
(1) The code adopted in section
1.000 shall not affect rights and duties that matured, penalties that were incurred and proceedings that were begun before the effective date in section
1.005.
(2) The repealing provision of the Springfield Code, 1965, shall not affect or impair any act done, offense committed or liability, penalty, forfeiture or punishment incurred before the effective date in section
1.005.

(1) The
provisions of this code that are the same in substance as code or
ordinance provisions that are in effect immediately before this code
becomes effective are construed as restatements and continuations
of the prior provisions.
(2) For
purposes of adoption of this code, the members of all city boards,
committees, or commissions created under a code or ordinance provision
repealed by this code shall continue to hold office for the period
of time specified in the repealed provision.
(3) A person
who holds a license, permit, right or privilege granted under a prior
code provision repealed by this code may continue to operate under
and use such license, permit, right or privilege until expiration
thereof according to the terms of the code provision under which the
license, permit, right or privilege was issued, unless the same is
revoked sooner by the city.

The sections, subsections, paragraphs, provisions, clauses,
phrases, and words of this code are severable. If a section, subsection,
paragraph, provision, clause, phrase, or word of this code is declared
by a court of competent jurisdiction to be unconstitutional or invalid,
the judgment shall not affect the validity of the remaining portions
of this code. Every other section, subsection, paragraph, provision,
clause, phrase or word of this code enacted, irrespective of the enactment
or validity of the portion declared unconstitutional or invalid, is
valid.
