No operator of any vehicle shall stop, stand, park or leave standing such vehicle in any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or other authorized officer or traffic sign or signal:
A. Within any divisional island unless authorized and clearly indicated with appropriate signs or markings.
B. On either side of any street between the projected property lines of any public walk, public steps, street or thoroughfare terminating at such street, when such area is indicated by appropriate signs or by red paint upon the curb surface.
C. In any area where the city manager determines that the parking or stopping of a vehicle would constitute a traffic hazard or would endanger life or property when such area is indicated by appropriate signs or by red paint upon the curb surface.
D. In any area established by resolution of the council as a no-parking area when such area is indicated by appropriate signs or by red paint upon the curb surface.
E. Upon, along or across any railway track in such manner as to hinder, delay or obstruct the movement of any car traveling upon such track.
F. In any area where the parking or stopping of any vehicle would constitute a traffic hazard or would endanger life or property.
G. On any street or highway where the use of such street or highway or a portion thereof is necessary for the cleaning, repair or construction of the street or highway or installation of underground utilities, or where the use of the street or highway or any portion thereof is authorized for a purpose other than the normal flow of traffic, or where the use of the street or highway or any portion thereof is necessary for the movement of equipment, articles or structures of unusual size, and the parking of such vehicle would prohibit or interfere with such use or movement; provided, that signs giving notice of such prohibited parking are erected or placed at least 24 hours prior to the effective time of such prohibited parking.
H. At any place within 20 feet of a crosswalk located at an intersection in any business district when such crosswalk is indicated by legally required signs or by red paint upon the curb surface, except that a bus may stop at a designated bus stop located within or adjacent to a crosswalk.
I. Within 20 feet of the approach to any traffic signal, boulevard stop sign or official electric flashing device.
J. Within an intersection except adjacent to curbs as may be permitted by local ordinance.
K. On a crosswalk, except that a bus engaged as a common carrier or a taxicab may stop in an unmarked crosswalk to load or unload passengers when authorized by the city council.
L. Within 15 feet of the driveway entrance to any fire station. This subsection shall not apply to any vehicle owned or operated by a fire department and clearly marked as a fire department vehicle.
M. Alongside or opposite any street or highway excavation or obstruction when such stopping, standing or parking would obstruct traffic.
N. On the roadway side of any vehicle stopped, parked or standing at the curb or edge of a highway.
O. Parking of Vehicles in Public Parking Lots.
1. No operator of any vehicle shall stop, stand, park, or leave standing such vehicle in any government-owned public parking lot within the city between the hours of 3:00 a.m. and 5:00 a.m. A violation of this section is an infraction.
a. An individual is exempt from this provision when parking at the police department for the purpose of active and lawful business with the police department, such as, but not limited to, reporting a crime or conducting a custody exchange.
2. No operator of any vehicle shall stop, stand, park, or leave standing such vehicle in any government-owned public parking lot within the city for more than 72 consecutive hours. To comply, the vehicle must be completely removed from the government-owned public parking lot and remain away from the parking lot for at least six hours. A vehicle parked more than 72 consecutive hours in any government owned public parking lot is subject to be towed and stored provided the following exists:
a. The city's designated enforcement official has made a reasonable effort to locate the operator of the vehicle in an attempt to get the operator to move the vehicle prior to the vehicle being towed and stored by the city.
b. The enforcement official has placed a 72-hour warning on the vehicle that specifies the time the enforcement official located the vehicle, the vehicle's license plate, vehicle identification number, make, model, and color. The warning shall include language specifying that failing to remove the vehicle within the 72-hour period will result in the vehicle being towed and stored.
c. Signs are posted by the city at all entrances to the government-owned public parking lot displaying this section and language summarizing this section.
d. Vehicles towed and stored through this section are subject to the same administrative fees as adopted by the city.
3. Notwithstanding the foregoing, residents in the downtown Upland area who have obtained a yearly residential parking permit or a yearly visitor parking permit (for their visitors) are approved to park at government-owned public parking lots between the hours of 3:00 a.m. and 5:00 a.m. and for a duration over 72 consecutive hours provided they follow the procedures below. The applicable downtown Upland area is defined as the area between A Street and D Street (to the south and north) and 1st Avenue and 3rd Avenue (to the west and east). Yearly residential parking permits and yearly visitor parking permits may be obtained through City Hall during normal business hours.
a. Individuals residing in the downtown Upland area may be issued a yearly residential parking permit free of charge after showing proof of residency in the downtown Upland area.
b. Each resident showing proof of residency in the Upland downtown area may be issued up to two yearly visitor parking permits per year free of charge. The city may approve additional yearly visitor parking permits for downtown Upland residents on a case-by-case basis.
c. Yearly residential parking permits and yearly visitor parking permits must be displayed in clear view on the vehicle that the permit is assigned to by the city.
d. Vehicles exempt under this provision shall be parked in the downtown government-owned city parking lot nearest the residence associated with the vehicle in the permit.
e. The possession of a yearly residential parking permit or a yearly visitor parking permit does not absolve the owner or operator of the vehicle from compliance with other applicable local, state, or federal law.
4. Subdivisions of subsection
O do not apply to City of Upland vehicles and do not apply to employees or contractors of the city when in the performance of their duties.
