Any animal which habitually barks, howls or yelps or which bites without provocation; or which molests passersby; or which runs at large or which are loosed upon or scratches, digs, defecates upon or otherwise causes damage to any lawn, tree, shrub, plant, building or any other public or private property other than the property of the owner or person in charge or control of such animal is hereby declared to be committing a nuisance. It shall be unlawful for any owner or person having custody of such animal to permit it to commit such nuisance. Horses and ponies being raised for transportation shall be exempt from this provision when in the right-of-way of a public street, but not when in the right-of-way for a sidewalk. Where the owner or person in charge or control of such animal immediately removes all feces deposited by such animal and disposes of same in a sanitary manner or repairs the damage done by such animal, the nuisance shall be considered abated.
