The Township Supervisors do hereby make a finding and set forth as a declaration of policy that the general characteristics and nature of Township development is in a transitional stage between urban and rural type development. There are portions of the Township that are relatively heavily populated and in these areas there exists a present need for sidewalks. Other portions of the Township are rather sparsely populated without any such need. However, in order to facilitate smooth, orderly and coherent development within the Township, there is a need for general authority to provide sidewalks along public streets as particular areas within the Township become more urban in nature and to provide for the maintenance of existing sidewalks.

Whenever it is determined by the Board of Supervisors that sidewalks shall be graded, constructed or curbed along any public road or street in the Township, the Board of Supervisors shall direct the Township Manager, by resolution at a public meeting of the Board of Supervisors, after public hearing, to serve written notices upon the owners of property abutting on said public roads or streets, requiring them to grade, construct, or curb such sidewalks within 90 days from the date of such notice. The notice shall specify the width, location and grade of the sidewalk and/or curb along with the materials to be used, such as, concrete, brick or other material.

Whenever it is determined by Township officials that sidewalks shall be repaired or replaced along any road or street in Township, the Township Manager or other agent of the Township shall serve written notices upon the owners of abutting property, requiring them to repair or replace such sidewalks within 90 days from the date of such notice. The notice shall describe the problem found with the existing sidewalk and the required correction to be made.

Upon failure of any owner of property to do or perform any work required by the notice provided for in §§21-502 or 21-503 of this Part within the time specified in such notice, the Board of Supervisors shall cause the same to be done and collect the cost of the work and material from the property owner, plus a penalty of 10%, in the manner provided by law.

Permits shall be required for the construction and replacement of sidewalks.
