A. 
The attorney shall:
1. 
Attend the meetings of the city council and advise the council on legal matters;
2. 
Prepare ordinances and resolutions of the city council;
3. 
Prepare contracts to which the city is a part and approve the same;
4. 
Advise the city council and all city officers concerning any legal problems affecting the city, the council, or the conduct of any city office.
B. 
It shall not be the duty of the city attorney to:
1. 
Represent people, residents of the city of South El Monte, in matters which affect their personal rights;
2. 
Prosecute any civil actions in behalf of the city nor defend any action prosecuted against the city;
3. 
Defend any action brought against any member of the city council or any city officer in his or her official capacity.

A. 
The salary of the attorney shall be fixed from time to time by the city council by minute order or resolution; salary and expense for additional services shall be paid for as determined by minute order and resolution.
B. 
The salary and necessary expenses of the city attorney shall be paid as a charge against the city.
