"For pay"
means for a fee, reward, donation, loan or receipt of anything
of value.
"Fortune telling"
shall mean and include telling of fortunes, forecasting of
future events or furnishing of any information not otherwise obtainable
by the ordinary process of knowledge, by means of any occult or psychic
power, faculty or force, including, but not limited to, clairvoyance,
clairaudience, cartomancy, psychology, psychometry, phrenology, spirits,
tea leaves or other such reading, mediumship, seership, prophecy,
augury, astrology, palmistry, necromancy, mind-reading, telepathy,
or other craft, art, science, cards, talisman, charm, potion, magnetism,
magnetized article or substance, crystal gazing, oriental mysteries,
or magic, of any kind or nature.

The applicant, with his application, shall file a surety bond
executed by such applicant as principal, with a surety company authorized
to do business in this state in the sum of five thousand dollars conditioned
for the faithful and honest conduct of business by the applicant and/or
his employees or agent. Such bond as to form, execution and sufficiency
shall be approved by the city attorney. The bond required by this
section shall be taken in the name of the people of this state and
every person injured by the wilful, malicious or wrongful act of the
principal acting in the course or scope of his employment or agency,
may bring an action on the bond in his own name to recover damages
suffered by reason of the wilful, malicious or wrongful act.

Every person who, for pay, actively conducts, engages in, carries
on, or practices fortune telling shall file a separate verified application
for a permit with the city treasurer. The application shall contain:
A. The
name, home and business address, and home and business telephone number
of the applicant;
B. The
record of conviction for violations of the law, excluding minor traffic
violations;
C. The
fingerprints of the applicant on a form provided by the sheriff's
department;
D. The
address, city and state, and the approximate dates where and when
the applicant practices a similar business, either alone or in conjunction
with others.

No person shall engage in, conduct, advertise, or carry on the occupation, business, science, or art of astrology, palmistry, phrenology, life reading, fortune telling, cartomancy, clairvoyance, necromancy or other occult art or science for pay without first having obtained a permit therefor in accordance with Chapters
5.08 and
5.36 of this code.
