A. 
No person shall trim, prune, cut, break, deface, destroy, burn or remove any tree, hedge, plant, shrub, or flower growing or to grow upon any city-owned public property within the city, unless authorized in writing to do so by the director of public works, or designee, or the city council.
B. 
No person shall trim, prune, cut, break, deface, destroy, burn or remove any tree, hedge or shrub from a public or city highway within the city, unless authorized in writing to do so by the director of public works, or designee.

Any person desiring to trim, prune, or remove any tree, hedge or shrub from any public or city highway shall file an application with the city surveyor and road commissioner.

A. 
The city surveyor and road commissioner may issue a written permit authorizing the trimming, pruning or removal of any tree, hedge or shrub within a public or city highway on such terms and conditions as he or she deems to provide protection to persons and property appropriate to provide protection to persons and property or may deny such permit.
B. 
Any person removing a live tree pursuant to a permit issued by the city surveyor and road commissioner shall, within thirty days following removal of such live tree, plant another tree of a type and in a location specified in the permit. The requirement of replanting another tree may be waived by the city surveyor and road commissioner where the requirement would impose an unreasonable hardship.

A. 
If the city surveyor and road commissioner deems that the trimming, pruning or removal of any tree, hedge or shrub within a city highway is necessary for the protection of the traveling public or public property, he or she shall, subject to the availability of funds, personnel and equipment, cause such tree to be trimmed, pruned or removed to provide such protection.
B. 
On application of any person to whom there has been issued a permit to trim, prune or remove a tree, hedge or shrub from a city highway, the city surveyor and road commissioner may trim, prune or remove such tree, hedge or shrub described in such permit, provided the cost thereof is paid by the permittee, and provided there shall first be deposited with the city surveyor and road commissioner a sum determined by him or her to be the estimated cost of such work. All such deposits shall be placed in a trust fund. Following completion of the work, the city surveyor and road commissioner shall determine actual cost of the work and transfer that portion of the deposit to the appropriate county fund and return the balance to the depositor. Should the original deposit be insufficient to cover the actual cost of the work, the permittee shall be liable to the city for the unpaid balance and shall promptly pay such amount to the city upon demand of the city surveyor and road commissioner.

No person shall plant any tree, hedge or shrub upon or within any city highway, public highway or public property within the city, unless authorized in writing to do so by the director of public works.

No permit for the planting of a tree, shrub or hedge within any public road, dedicated right-of-way or city highway shall be issued unless the species of the tree, shrub or hedge to be planted is one approved by the director of public works. The permit for the planting of a tree, shrub or hedge may be issued upon such terms and conditions as the road commissioner determines appropriate to protect persons and property or may be denied.

No person shall injure, deface, or remove any protective structure placed around any tree or plant growing upon any public or city highway or public property in the city.
