This chapter is intended to control usage of public solid waste receptacles provided by the city of Lemon Grove for general public usage in common areas of commercial locations, public buildings, parks, and other public property. The purpose of the provision of trash receptacles is to provide place for the general public using public areas or facilities to safely dispose of normal non-hazardous solid waste generated during the use of public areas or facilities or commercial areas. This chapter is further intended to protect the environment from pollution that is generated by the general public who have no reasonable alternative method of disposal of solid waste, including incidental liquid waste.

"Common areas"
include publically accessible areas of public facilities, parks and common areas, maintained by the public, of commercial areas.
"Solid waste receptacle"
includes any bin, can or other storage unit used to store waste products, primarily consisting of solid waste used by the general public. Solid waste as the term is used in this chapter, does not include hazardous waste, human waste, or other waste not normally generated by use of common areas covered by this chapter.
The terms contained in this chapter shall generally be construed as defined in common usage except terms specifically defined herein and as defined in Chapter 1.08 of the Lemon Grove Municipal Code.

No person or business establishment shall use trash receptacles provided by the city of Lemon Grove for general public use to dispose of solid or liquid waste of any type or kind generated by the business establishment or person's business or home for which the business establishment or person has the ability to retain commercial disposal service. Use of publically provided solid waste receptacles in public spaces are only intended for the use of the general public while using the public spaces where the solid waste receptacles are located.

Violation of any provision of this chapter shall be either a misdemeanor or an infraction and punishable under the provisions of Section 1.12.010 of the Lemon Grove Municipal Code. Further, any violation of this chapter shall be considered a public nuisance and the property, residence or business generating the improperly disposed waste shall be subject to the remedies for nuisance allowed by law, including, but not limited to, Section 1.14.060(A) of the Lemon Grove Municipal Code.
