(a) 
The city council may, by ordinance or resolution, upon determining that there is a need to take action to protect the public health, safety, and welfare, designate a specific geographical area as a "safety enhancement zone" and specify the date and/or time that the designation is effective. The designation of a safety enhancement zone shall be predicated upon the city council finding both that the geographical area is subject to unique conditions and circumstances during a specific period of time that create the potential for a significant threat to public health and safety, and that the threat would be reduced by enhanced penalties for violations of certain provisions of the Davis Municipal Code.
(b) 
The ordinance or resolution establishing a safety enhancement zone shall contain the following provisions:
(1) 
A description of the geographical area comprising the safety enhancement zone; and
(2) 
The date and time, or other specific description of the time period, during which the safety enhancement zone designation is applicable to the geographical area.

Any person who violates a designated provision of the Davis Municipal Code within an area that the city council has designated as a safety enhancement zone, and during the time that designation is effective, shall be subject to an enhanced fine. The enhanced fine shall be twice the amount of the fine applicable to a violation of the designated municipal code provision, up to a maximum of one thousand dollars.

(a) 
Enhanced penalties for violations committed within a designated safety enhancement zone during the time that designation is effective, shall apply to violations of the following provisions of the Davis Municipal Code:
(1) 
Davis Municipal Code Section 24.05.010 (general noise);
(2) 
Davis Municipal Code Section 26.04.020 (possessing an open container or consuming an alcoholic beverage in public places or in certain private parking lots);
(3) 
Davis Municipal Code Section 26.01.045 (urinating in public);
(4) 
Davis Municipal Code Section 34.02.010 (smoking in public).
(b) 
Each act constituting a violation shall be deemed a separate and distinct offense.

A violation under this chapter may be prosecuted either criminally or administratively pursuant to Chapter 1 of the Davis Municipal Code.
