South Avenue - Garwood Mall.
(1) 
No person shall park a vehicle and no stopping or standing of motor vehicles shall be permitted in the Shopping Center Complex located at 300 South Avenue, known as the Garwood Mall, on the paved roadway adjacent to the curb sidewalk fronting the stores, designated as fire zones by the Garwood Fire Department on the paved roadway of the rear of the stores nor in any area adjacent to the parking stalls. The provisions of Subtitle I of Title 39 of the New Jersey Statutes Annotated is hereby determined to be applicable and is adopted as a part of this chapter by reference.
(2) 
Vehicles shall be parked in the Garwood Mall only in authorized parking areas and only within the painted parking stalls.
(3) 
Parking shall be prohibited at all times in parking spaces set aside for the handicapped and which are so designated by signs or other markings, except by persons who have been issued Special Vehicle Identification Cards by the Division of Motor Vehicles pursuant to the provisions of N.J.S.A. 39:4-204, 39:4-205, 39:4-206, 39:4-207, Public Law 1981-C-1936 and Public Law 1983-C-1996 when using a motor vehicle on which is displayed a certificate for which a Special Vehicle Identification Card has been issued pursuant to said law.
(4) 
The site plan approval by the Planning Board of the Borough of Garwood is incorporated herein by reference.
K. 
South Avenue - Lidl Complex.
(1) 
No person shall park a vehicle on the premises of the Garwood Lidl Complex located at 3-10 South Avenue, Garwood, New Jersey, on the paved roadway adjacent to curbed sidewalks fronting the premises, the sideline in the rear of the premises nor in any area adjacent to the parking stalls.
(2) 
Vehicles shall be parked in the Garwood Lidl Complex only in authorized parking areas and only within the painted parking stalls.
(3) 
Parking shall be prohibited at all times in the parking spaces set aside for the handicapped and which are so designated by signs or other markings, as shown on the attached site plan which will be made a part of this chapter, except by persons who have been issued Special Vehicle Identification Cards by the Division of Motor Vehicles pursuant to the provisions of N.J.S.A. 39:4-204, 39:4-205, 39:4-206, 39:4-207, Public Law 1981-C-1936 and Public Law 1983-C-1996 when using a motor vehicle on which is displayed a certificate for which a Special Vehicle Identification Card has been issued pursuant to said law.
(4) 
Parking shall be prohibited at all times in those areas designated by signs and yellow paint as fire lanes.
L. 
Spruce Avenue.
(1)

A. 
It shall be unlawful for any person, firm or corporation to park or permit the parking of any truck, tractor, tractor trailer, camper, recreational vehicle, camp car, mobile home, trailer or bus on any municipal street or portion thereof within the Borough of Garwood between the hours of 12:00 midnight and 6:00 a.m.
B. 
Any of the above enumerated vehicles parked on a municipal street or a part thereof between the aforesaid hours in violation of the chapter shall be deemed a public nuisance and any such vehicle may be removed by or at the direction of the Garwood Police Department, in which case before regaining possession of the vehicle.
C. 
The trucks, tractors, tractor trailers, trailers and buses which are prohibited from parking on the municipal street or any portion thereof within the Borough of Garwood between the hours of 12:00 midnight and 6:00 a.m., pursuant to this chapter are those vehicles which have a registered gross weight in excess of 8,000 pounds; or which shall be equipped with dual wheels, whether front or rear, or trailers, irrespective of the gross registered weight of the vehicle.
D. 
No person, firm or corporation shall park or permit the parking of any trailer that is not connected to a towing motor vehicle on any municipal street or portion thereof within the Borough of Garwood at any time of the day. This prohibition shall not apply to commercial trailers or construction type trailers while actively being used in business or construction.

A. 
Whenever snow has fallen and there is an accumulation of three inches or more of snow on any street or highway, no vehicle shall be parked on any street or highway, or portion thereof in the Borough of Garwood. This prohibition shall remain in effect until and after the snow has ceased and the street has been plowed after the cessation of the snowfall.
B. 
In the event that weather conditions, accidents, fires, street sweeping, public celebrations, or any other emergency requires the avoidance of hazards or other conditions which interfere with the free flow of traffic, the Chief of Police or, in his absence, the ranking police officer of the Department, is authorized to declare an emergency and to direct the posting of "Emergency No Parking" signs. Upon the declaration of the emergency and the posting of such signs, there shall be no parking upon the streets or sections of streets where such signs have been posted. Notification of the declaration of the emergency and the posting of such sighs shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
C. 
Any vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle by towing or otherwise. The owner of such vehicle shall pay the removal costs and any storage charges that may result from such removal prior to regaining possession of the vehicle.

A. 
Only persons who have been issued special vehicle identification cards by the Division of Motor Vehicles pursuant to the provisions of N.J.S.A. 39:4-205 and N.J.S.A. 39:4-197.5 shall park in any parking space designated for handicapped persons as set forth in Subsection B below or by other lawful ordinance, resolution or regulation of the Borough of Garwood or other authority having jurisdiction.
B. 
The following parking spaces shall be designated as handicapped parking spaces restricted for use to persons who have been issued special vehicle identification cards as set forth in Subsection A above:
(1) 
Center Street. On the easterly side, from a point along the easterly curbline 25 feet north of the intersection of Myrtle Avenue and Center Street to a point 45 feet north of the intersection of Myrtle Avenue and Center Street.
C. 
Penalties. Violations of this section shall be subject to punishment pursuant to N.J.S.A. 39:4-197(3)(c).

A. 
Parking prohibited. No person except a permittee under this section shall park a motor vehicle in any restricted handicapped parking zone in front of any residence so designated by ordinance pursuant to N.J.S.A. 39:4-197.6.
B. 
Designation of restricted handicapped parking zones. Restricted handicapped parking zones in front of a residence may be established from time to time by the Mayor and Council by ordinance, provided that such residence is occupied by a handicapped person or persons as defined by law, and:
(1) 
Such person or persons are holders of current drivers' licenses issued by the State of New Jersey;
(2) 
The motor vehicles to be parked in such zones are equipped with such special attachments and devises as the Director of the Division of Motor Vehicles of the State of New Jersey may deem necessary to provide for the safe operation thereof by such persons; and
(3) 
Such parking is not otherwise prohibited and the permitting thereof would not interfere with the normal flow of traffic.
C. 
Delineation and signs. The designated restricted parking zones established in front of residences by Ordinance shall be delineated by or at the direction of the Chief of Police, who shall see to the erection of appropriate signs pursuant to N.J.S.A. 39:4-198.
D. 
Permits. The Chief of Police shall provide for the issuance of permits which identify a specific motor vehicle and the location wherein it is to be parked. Such permits shall be issued only to persons who can prove ownership and operation of the motor vehicle and residency at the location specified thereon. The permit shall be 5 1/2 inches by 8 1/2 inches in size, and shall bear an appropriate certification of authenticity and shall be displayed prominently within the vehicle when it is parked so as to be seen from the middle of the street. Only a motor vehicle for which a valid permit has been issued and which has such permit properly displayed shall be permitted to be parked in the restricted parking zone indicated on such permit.
E. 
Fee for permit. Permits shall be issued for each calendar year and may be renewable by mail. The annual permit fee per calendar year shall be $5.
F. 
Lapse of permit. Upon the lapse of permit, whether caused by the failure of the permittee to reapply, or the death of the permittee, or for any other reason, the restricted handicapped parking zone shall be deemed no longer to be so designated, and all restrictive delineations and signs shall be removed upon the direction of the Chief of Police.
G. 
Penalties. Any person parking a motor vehicle in a restricted parking space or zone as set forth in this section without a permit shall be subject to punishment pursuant to N.J.S.A. 39:4-197, Subsection (3)c.

A. 
Parking prohibited. No person shall stand or park any motor vehicle in any space on public or private property in the Borough of Garwood appropriately marked for vehicles for the physically handicapped pursuant to P.L. 1977, c. 202 (N.J.S.A. 39:4-197.5), P.L. 1975, c. 217 (N.J.S.A. 52:27D-119 et seq.) or any other applicable law unless the vehicle is authorized by law to be parked therein and a handicapped person is either the driver or a passenger in that vehicle. A "handicapped person" as used in this section is defined as a person who has been issued a special identification card by the Division of Motor Vehicles pursuant to the provisions of P.L. 1949, c. 280 (N.J.S.A. 39:4-204 et seq.) or Section 1 of P.L. 1977, c. 202 (N.J.S.A. 39:4-197.5).
B. 
Enforcement. State, county or municipal law enforcement officers or parking enforcement officers shall enforce the parking restrictions on spaces appropriately marked for vehicles for the physically handicapped on both public and private property.
C. 
Delineation and signs. All parking spaces reserved for the handicapped on public or private property shall be designated by appropriate signs as prescribed by law and shall include the notice provisions contained in N.J.S.A. 39:4-198 as amended.
D. 
Penalties. Violations of this section shall be subject to punishment pursuant to N.J.S.A. 39:4-197, Subsection (3)c.

(1) 
Whenever snow has fallen and the accumulation is such that it covers a parking lot, no vehicle shall be parked in any municipal parking lot. This parking prohibition shall remain in effect after the snow has ceased until the parking lot has been plowed.
(2) 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and any police officer may provide for the removal of such vehicle. The owner shall pay the removal costs of the vehicle and storage that may result from such removal before regaining possession of the vehicle.
(3) 
The approval of Council is required to close the parking lot for special events lasting more than two hours.
(4) 
The Municipal Clerk may authorize the Chief of Police to mark all parking stalls "15 minute parking" on Primary Election Day and General Election Day.

F. 
Parking rules for municipal lots.
(1) 
No person shall park a vehicle in any municipal parking lot except in authorized parking areas and within painted parking stalls.
(2) 
No person shall park a vehicle in any municipal parking lot in any parking space set aside for the handicapped and so designated by sign or other marking except a person qualified to do so in accordance with law.
(3) 
Head-in parking only, except for emergency vehicles, shall be permitted in all municipal parking lots.

A. 
Up to five parking stalls in John F. Kennedy Plaza, as determined by the Chief of Police.
B. 
Parking in the Limited Business Parking areas shall be by permit only from the hours of 5:00 a.m. to 7:00 p.m., Monday through Saturday. No owner or operator of any motor vehicle shall cause or permit such motor vehicle to be parked in such Limited Business Parking area, except by permit, during such hours; provided, however, that such prohibition shall not apply after 11:00 a.m. to any parking space which has not been utilized by a permitted motor vehicle by 11:00 a.m. At 11:00 a.m., if not utilized for Limited Business Parking, the spot for that day will revert to two-hour parking.
C. 
During the hours and days set forth in Subsection B of this section, it shall be unlawful for any person to cause, allow, permit or suffer any vehicle registered to or operated by any such person to be parked in the above-described Limited Business Parking areas without the required permit being affixed to said motor vehicle subject to the exemption listed above in Subsection B.
D. 
The Borough Clerk shall issue permits to businesses applying therefor on payment of the required fees, in accordance with this article. Said permits shall be issued on a quarterly basis for three-month periods commencing on the first day of January, April, July and October of each year. Each permit shall authorize the business to which it has been issued to park a designated motor vehicle in the Limited Business Parking area during the hours designated in this article.
E. 
The permit fee shall be as follows:
(1) 
$75 per quarter.
(2) 
Lost tag fee/replacement tag: $25.
F. 
At the time of the issuance of each permit, the Borough Clerk shall also issue to the business to which the permit is granted a tag indicating the permit number, year and expiration date of the permit. The tag shall be displayed from the vehicle's rearview mirror.
G. 
Each business may receive up to a maximum of three Limited Business Parking permits/hang tags per leased spot.
H. 
The regulations pertaining to the Limited Business Parking areas established under this section shall be effective only during the hours and on the days set forth in Subsection B of this section.
I. 
Limited Business Parking permits shall not be subleased or transferred by the permit holder.

D. 
Parking fees.
(1) 
Parking fees are established at $0.50 per hour except for as set forth below.
(a) 
Any parking in a six-hour-maximum zone listed in § 21-8.8C(1), the parking fee shall be as follows:
[1] 
$0.50 per hour for the first two hours; and
[2] 
$1 per hour for hours three and four; and
[3] 
$1.50 per hour for hours five and six.
(2) 
All transaction fees are separate and the responsibility of the vehicle owner or operator.
(3) 
Electronic application payment services signage shall be installed to afford electronic payment and to provide parking rates. The operator, immediately after parking the operator's vehicle, shall deposit or cause to be deposited in the electronic application payment service the posted fee required for the spot occupied by the operator's vehicle.
E. 
Parking in paid spaces where parking time has expired.
(1) 
It shall be unlawful for any person to place, permit or allow any vehicle owned, driven or controlled by him or her to be placed or parked in any parking zone in which is located any electronic application payment services signage without immediately depositing the electronic payment. It shall be unlawful for any person to place, permit or allow any vehicle owned, driven or controlled by him or her to be placed or parked or remain in such parking zone beyond the duration of time allowed in such parking zone as designated on the electronic application payment services signage as established by the provisions of this chapter.
(2) 
It shall be unlawful for any person to place, permit or allow any vehicle owned, driven or controlled by him or her to remain in any parking zone beyond the duration of time allowed in such parking zone by repeatedly or periodically depositing additional payments extending the time the vehicle is parked beyond the allowed limit for the parking zone in which the vehicle is located.
F. 
Enforcement of article; issuance of summons for violations; payment and disposition of fines. The Police Department, through its officers and parking enforcement officers, shall enforce this article and shall make a record of any violation, including where the violation occurred, the state license or registration number of the vehicle, the date concerning overtime or illegal parking and any other pertinent details. The police officer observing the violation shall attach to the vehicle a summons directing the owner or operator of the vehicle to appear before the Municipal Court of the Borough on a regular court date or report to the Violation Clerk and pay the prescribed fine in accordance with the rules of the State Supreme Court dealing therewith. Any person receiving a summons for violating any of the provisions of this article may, in any event, be liable to any of the penalties imposed by this article upon conviction of such violation in the Municipal Court.
G. 
Municipal paid parking fees exemption for disabled veterans or Purple Heart recipients. In accordance with N.J.S.A. 39:4-207.10, a person who is a disabled veteran or recipient of the Purple Heart is exempt from payment of municipal paid parking fees when a motor vehicle owned by the disabled veteran or the Purple Heart recipient displays disabled veteran's or Purple Heart license plates or a placard issued by the New Jersey Motor Vehicle Commission, unless the vehicle has been parked in one location for more than 24 hours. The exemption shall apply only when the disabled veteran or recipient of the Purple Heart to whom the special license plates or placards have been issued is either the driver, or a passenger, of the vehicle
H. 
Exceptions: Five of the parking spaces that fall within § 21-9, Paid parking, will be designated 15-minute parking spaces. These 15-minute parking spaces will be free for up to a maximum of 15 minutes, after which it shall be unlawful for any person to place, permit or allow any vehicle owned, driven or controlled by him or her to remain in any parking zone beyond the duration of time allowed (15 minutes) in such parking zone as designated on posted signage. These spaces will be designated as 15-minute spaces between 8:00 a.m. and 8:00 p.m., Mondays through Saturdays. These spaces will be located in the three following locations:
(1) 
Center Street, 50 feet south of South Avenue on the east side of Center Street.
(2) 
300 block of Willow Avenue, located near the northeast corner of Willow Avenue and Center Street.
(3) 
400 block of Willow Avenue, located near the northwest corner of Willow Avenue and Center Street.
(4) 
North Avenue, two (2) spaces on the north side located between Walnut Street and Cedar Street, as designated by the Chief of Police by appropriate signage.
