The officers of the city other than the mayor and aldermen shall be a city secretary, a city attorney, a chief of police, a health officer, a fire marshal, a city judge, and such other officers and agents as the city council may from time to time direct.

(a) 
Appointment; compensation.
The office of the city attorney shall be elected by the city council for a period of one year, and he shall receive such compensation for his services as may be from time to time determined by the city council, but the city council shall have the power to discharge such city attorney at any time without cause.
(b) 
Duties.
It shall be the duty of the city attorney to attend the meetings of the city council, advise it in legal matters, represent the city in the municipal court, collect delinquent taxes, and attend to such matters as the city council may require of him.

(a) 
Powers and duties.
The office of city secretary shall have all the powers and perform all the duties prescribed to it by law. These duties shall include the following:
(1) 
Attend every meeting of the city council and shall keep accurate minutes of the proceedings of said council in a book provided for that purpose.
(2) 
Engross and enroll all motions and resolutions of the city council and ordinances of the city council.
(3) 
Attest all commissions and licenses issued by the mayor.
(4) 
Preserve and keep in order all books, papers, documents, and records of the council, and keep a record of such books, papers, documents, and records.
(5) 
Have custody of all laws and ordinances of the city.
(6) 
Have custody of the seal of the city and shall affix the same to obligations of the city only by order of the city council.
(7) 
Perform such services and comply with such regulations as may be prescribed by ordinance or resolution.
(8) 
In order to comply with the open meeting law, post in a place readily accessible to the public and 72 hours preceding such meetings, notices of the meetings of the city council.
(9) 
Perform all other necessary duties that pertain to such office and all other duties as required by the mayor and the city council, as though such services were particularly required by ordinance.
(b) 
Appointment and discharge; compensation.
The city secretary shall be appointed for an indefinite period of time and shall be subject to discharge at the will of the city council. He shall receive such compensation as the city council shall fix from time to time by ordinance or resolution, and shall furnish such surety bond as may be required by the city council by ordinance or resolution, the premium of which is to be paid by the city.
(c) 
Bond.
He shall give bond in such amount and such form as the city council may from time to time prescribe, with good sufficient securities, and the city council may require a new bond whenever, in their opinion, the existing bond is insufficient, and whenever such bond is required, he shall perform no official act until said bond shall be given and approved. He shall perform all such other duties, and in such manner and according to such rules and regulations as the city council may at any time hereafter prescribe.

(a) 
Office created.
The office of city treasurer is hereby created.
(b) 
Duties.
The city treasurer shall perform the duties of city treasurer as contained in Local Government Code section 22.075, as amended, and those duties required of the city secretary as contained in Local Government Code sections 22.073(d), (e), (f), and (g) as amended.
(c) 
Bond.
The city treasurer shall post a bond by placing $1,000.00 in an escrow account managed by the city. Said bond shall be paid by the city and is executed on the condition that the city treasurer will faithfully discharge the duties of the office, as required by Local Government Code section 22.075.
(d) 
Payments for city expenses.
In accordance with Local Government Code section 22.075, the city council hereby directs that an order be issued authorizing that all payments for city expenses be made by the city treasurer.

The position and office of city administrator is hereby created and the criteria for appointment, removal, compensation, and the authorities, powers, duties and responsibility of the office of city administrator shall be as hereinafter set forth.

The city administrator shall be appointed by a majority vote of the city council and shall serve at the will of a majority of the city council. The city council may designate some qualified person to act in the absence or disability of the city administrator.

The city administrator shall receive such compensation and benefits as may be established from time to time by the city council.

The city administrator shall be the chief administrative officer of the city and shall be responsible to the city council for the proper administration of all affairs of the city as provided in this division. To that end, the city administrator shall have the following authority, duties and responsibilities:
(1) 
Prepare job descriptions for approval by the city council; delegate duties to the officers and employees of the city; appoint persons to fill the budgeted positions provided that such appointments shall, with respect to the chief of police and city secretary, be with the city council's concurrence; terminate, suspend, or discipline employees who are not department heads, subject to their right of appeal to the city council; recommend the merit increases, salary, discipline, suspension or removal of department heads to the city council; exercise supervision and control over the personnel, drug and substance abuse testing policy and program of the city; and, as he or she may determine advisable from time to time, make recommendations to the city council on any and all personnel, performance, administration, management, financial and general governance issues.
(2) 
Direct, coordinate, and provide oversight over all departments of the city, and, in the event of a conflict between any matter of direction and oversight by the city administrator and the supervision undertaken by the mayor, the matter shall be referred to the city council for action.
(3) 
Perform administrative and management functions including, but not limited to, the following:
(A) 
Ensure that all applicable laws and ordinances are enforced;
(B) 
Supervise and inspect the conduct of all subordinate officers and employees of the city;
(C) 
Cause all negligence, carelessness, and violations of duty by the employees and officers to be given appropriate consideration; and
(D) 
Communicate and make recommendations to the city council for the administration and management of the city.
(4) 
Attend all meetings of the city council for which he or she is not excused, with the right to participate in the discussion but having no vote.
(5) 
In consultation with the city secretary, and the mayor as chief budget officer of the city, prepare, review and submit to the city council prior to the beginning of each fiscal year a budget for proposed expenditures for the ensuing year together with a message describing the important features of said budget. The city secretary shall render such assistance as the city administrator may find reasonably necessary in the preparation and submission of said budget. The city administrator shall further, as directed by the city council, assist the city council with respect to its consideration of said budget. The city administrator shall further assure the proper administration of the budget after its adoption by the city council.
(6) 
Prepare and submit to the city council as of the end of the fiscal year a complete report on the finances and administrative activities of the city for the preceding year.
(7) 
Keep the city council advised of the financial condition and future needs of the city and provide such information and service as may be deemed reasonably necessary. The city administrator shall further advise and assist the city council to assure the accomplishment of the annual audit of the city.
(8) 
Supervise the purchase of all materials, supplies, and equipment for which funds are provided in the budget; and purchase budgeted materials and supplies necessary for operation or maintenance of the city services. All expenditures shall be approved with compliance with the competitive bidding procedures of state law. No purchase shall be made, contract let, or obligation incurred for any item or service which exceeds the current departmental budget appropriation without a supplemental appropriation approved by the council. The city administrator shall advise the city council on the advantages or disadvantages of contract and bid proposals. The city administrator may issue written rules governing procedures for purchasing consistent with this section and with applicable state law.
(9) 
In the event of accident, disaster, or other circumstance creating a public emergency, the city administrator shall provide the mayor such assistance as may be necessary and may award contracts and make purchases for the purpose of meeting said emergency, but shall file within seventy-two (72) hours with the city council a certificate describing any such emergency and showing the necessity for such emergency purchases, together with an itemized count of all such expenditures.
(10) 
The city administrator shall have such further authority, duties and responsibilities as may be reasonably implied from the terms of this division and as heretofore or hereafter provided by the city council.
(11) 
The city administrator shall be bonded in an amount determined from time to time by the city council, which bond shall be conditioned upon the good and faithful performance of the duties, responsibilities and performances of the office and position of city administrator. The premium of the bond shall be paid by the city.

The limited administrative and personnel duties and responsibilities of the mayor, with respect to the day-to-day operation of the city, which are by statute to be performed by solely by the mayor, may be delegated by the mayor to the city administrator. The duties and responsibilities of the city administrator shall be in addition to, and not in lieu of, the day-to-day administrative and personnel duties of the mayor. To the fullest extent not in conflict with state law, this division, or the express actions and directions by a majority vote of the city council, the city administrator shall have the responsibility and the authority incident thereto, for the day-to-day supervision and management of the city and the salaried officers, employees and personnel of the city.
