1. 
No person shall, between the hours of 10:00 p.m. and 7:00 a.m. of the following day, make or cause to be made any loud, unnecessary or unusual noise which disturbs the peace or quiet of Kelly Township or which causes discomfort or annoyance to any reasonable person of normal sensitivities and/or hearing residing in Kelly Township nor shall any person owning, leasing or controlling land within Kelly Township permit said noise to originate or emanate from said land. The source of said noise may include but not be limited to:
A. 
Radios, televisions, cassette and disc players, phonographs, musical instruments, sound amplifiers or similar devices which produce, reproduce or amplify sounds.
B. 
The operation of motor vehicles, machinery or similar equipment.
C. 
Repairing, rebuilding, testing or otherwise working on any motor vehicle, motor boat, motorcycle, aircraft, machinery or similar equipment.
D. 
Any animal or bird which howls, barks, meows, squawks or makes other sounds continuously and/or consistently for a period of 10 minutes or which makes said sound intermittently for 1/2 hour if said animal or bird is kept, possessed, harbored, controlled or maintained by a person.

For the purposes of this Part:
PERSON
Includes but is not limited to an individual, corporation, partnership, unincorporated association, limited liability company or similar entity.

The provisions of this Part shall not apply to land cultivation, general agricultural uses, boarding and raising livestock and poultry, animal husbandry, horticultural activities and concentrated animal operations conducted in the Township's Agricultural Zoning District as established from time to time by Chapter 27, Zoning, of the Township Code, to the temporary or special events or occasions approved by the Township, to normal business operations or to refuse removal.

Any person who violates or permits a violation of this Part 1 shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this Part 1 that is violated shall also constitute a separate offense. The Township Solicitor may assume charge for the prosecution without the consent of the District Attorney as required by the Pennsylvania Rules of Criminal Procedure.

The officers or other persons responsible for the operation of a corporation, partnership, unincorporated association, limited liability company or similar entity may be prosecuted for a violation of this Part committed by said corporation, partnership, unincorporated association, limited liability company or similar entity.

The Supervisors, either individually or jointly, and such person or persons as the Board of Supervisors shall appoint by resolution from time to time may enforce the provisions of this Part.
