All flood prone areas of the Township of Kelly shall be those areas inundated by waters of the 100-year flood and identified as such in the Flood Insurance Study dated December 2, 1974, effective March 1, 1977, prepared for the Township of Kelly by the Federal Insurance and Mitigation Administration as amended from time to time.

For the purposes of this chapter, the boundaries of all identified flood-prone areas within the Township of Kelly are shown on the "Official Map of Flood-prone Areas of the Township of Kelly," which is available for inspection at the Township of Kelly Offices.

For the purposes of this chapter, the boundaries of areas considered to be flood prone may be revised or modified by the Township only where necessary because of natural or man-made changes which have occurred and/or require more detailed studies undertaken by a qualified agency or individual may document the need for such revision. All such changes shall be subject to the approval of the Federal Insurance and Mitigation Administration or such other governmental agency as may be required by law or regulation.

Should a dispute arise concerning the boundary of any flood-prone area, an initial determination shall be made by the Zoning Officer and any party aggrieved by this decision may appeal to the Township. The burden of proof shall be on the appellant.
