It is the legislative intent of the Town Board of the Town of Blooming Grove to establish a chapter that would properly govern the Town-owned parks and parklands.
No person shall enter into, remain or be found in any Town park or parkland within the Town of Blooming Grove on foot or by vehicle between the hours of 11:00 p.m. in the evening and 6:00 a.m. the following morning without a special permit issued by the Town.
No person shall bring into any Town park or have in his/her possession while in any Town park any glass bottle or any other receptacle made of glass.
A. 
No person shall consume cannabis and/or marihuana products.
B. 
All types of smoking/vaping are prohibited.
C. 
No pets are allowed on athletic field(s) and/or within 200 feet of said athletic field(s).
D. 
No bicycle or any form of bike is allowed on athletic field(s).
E. 
No motorized equipment is permitted in any parks.
F. 
The consumption of alcoholic beverages or possession of open containers of alcoholic beverages is prohibited.
G. 
Picnicking, including the use of camp stoves for cooking, is prohibited.
H. 
Discharge of fireworks or firearms is prohibited.
I. 
Use of or consumption of tobacco products or illegal drugs is prohibited.
J. 
Use or possession of glass containers, bottles, or other breakable glass product is prohibited.
K. 
Use of the park after hours is prohibited.
L. 
Failure to obey any rule or regulation posted in any park is prohibited.
M. 
Littering or depositing of debris, garbage, refuse, bottles, cans or abandoned articles of personal property is prohibited.
N. 
Selling, peddling or hawking any food, beverages or wares without a permit is prohibited.
O. 
Defacing any property or placing of posters or placards or stickers thereon is prohibited.
P. 
Engaging in fighting or in violent, tumultuous or threatening behavior is prohibited.
Q. 
Making unreasonable noise is prohibited.
R. 
Using abusive or obscene language or making obscene gestures is prohibited.
S. 
Obstructing vehicular or pedestrian traffic is prohibited.
T. 
Congregating with other persons and refusing to comply with a lawful order of law enforcement officers to disperse is prohibited.
U. 
Creating or causing to be created a hazardous or physically offensive condition by any act which serves no legitimate purpose is prohibited.
V. 
Nudity in any park is prohibited.
W. 
The use of campfires or bonfires for any purpose is prohibited.
X. 
Overnight camping is prohibited.
All persons who are present in any park shall comply with any and all park rules and regulations of the Town of Blooming Grove, whether contained in this chapter or posted within such parks. The Town Board may, by resolution, adopt additional regulations, as necessary, to be posted in Town parks, and failure to comply with such posted rules and regulations shall be deemed a violation of § 165-4L of this chapter.
Any person committing an offense against any provision of this chapter shall be guilty of a violation punishable by a fine not exceeding $50 for the first offense and $100 for each and every offense thereafter. The continuation of an offense against the provisions of this chapter shall constitute a separate and distinct offense for each day or instance the offense is continued or occurs.
Any on-duty police officer, Code Enforcement Officer, or any other person authorized by resolution of the Town Board will enforce all provisions of this chapter. All such enforcement officers shall have the right and authority to issue appearance tickets for the violation of any provision of this chapter or any prohibition or limitation on usage imposed pursuant to this section.
This chapter is enacted by authority of § 20, Subdivision 5, of the Municipal Home Rule Law and any other law referenced herein as authority herefor.
All ordinances, local laws and parts thereof inconsistent with this chapter are hereby repealed.
