This article shall be known as the "Town of Steuben local law for opting out of the exemption from taxation for certain solar or wind energy systems as authorized under § 487 of the New York State Real Property Tax Law, and any subsequent expansions thereto."
This article is being enacted by the Town of Steuben to provide that it hereby opts out and will not participate in or grant the exemption from taxation for certain solar or wind energy systems as authorized under § 487 of the New York State Real Property Tax Law, and any subsequent expansions thereto, specifically including in said opt-out the 2017 expansions thereto of micro-hydroelectric energy systems, fuel cell electric generating systems, micro-combined heat and power generating systems and electric energy storage systems.
If any clause, sentence, paragraph, section or part of this article shall be adjudged by any court of competent jurisdiction to be unconstitutional or invalid, such judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which such judgment shall have been rendered.
