Chapter 349: Permit Parking on Residential Streets and Municipal Lots

§ 349-1 Designation of restricted streets; issuance of permits.

Whenever the Chief of Police or his designee shall determine that certain streets exclusively or primarily servicing residential land uses, or portions of such streets, are being used for parking by the operators of vehicles, which operators do not reside on said streets, and that the average number of such vehicles parking in such manner is in excess of 25% of the number of parking spaces on such streets and that the total number of parking spaces actually occupied exceeds 5% of the total number of parking spaces on such streets, as disclosed by an engineering and/or traffic study, then the Chief of Police, or his designee, shall prohibit parking, except by permit as hereinafter provided, during the hours when the above-stated conditions have been found to exist on those streets or portions affected thereby as established by such engineering and/or traffic study.

In such cases, the Chief of Police shall cause appropriate signs to be posted on those streets or portions thereof affected prohibiting all parking thereon during the hours when the above-stated conditions have been found to exist, except parking by the holders of permits to be granted only under the following terms and conditions:

(1)

To persons who are residents on any street or portion thereof upon which parking is so restricted, for every vehicle owned by such person and registered in the State of New Jersey.

(2)

To persons who are visitors of any persons who are residents on any street or portion thereof upon which parking is so restricted, subject to the proviso, however, that not more than three such permits shall be issued and outstanding at any one time for the use of visitors of any one dwelling unit on any said street or portion thereof upon which parking is so restricted.

(3)

To persons who do business with any persons who are residents on any street or portion thereof upon which parking is so restricted, subject to the proviso, however, that the parking prohibitions and restrictions of this chapter shall not apply to service or delivery vehicles which are being used to make service calls or deliveries.

On the application of any person who resides on any said street upon which parking is so restricted, the Chief of Police, or his designee, may issue permits to be valid for only one day and for no more than eight hours on that day upon a showing by such person that during the hours for which any such permit is to be issued for such person's residence will be used in such a way as to be consistent with its residential character and with municipal ordinances and regulations restricting the use thereof to residential purposes and that visitors to such person's residence will not be able to park in the immediate vicinity thereof without violating the restrictions imposed by this chapter. If the Chief of Police shall approve such application and further find that the issuance of any such requested permits will not unduly impair traffic safety during the time of their validity, then he shall issue such permits and may limit the streets or portions of streets for which they shall be valid. The total number of such permits issued shall not at any time exceed 35% of the total number of parking spaces on any street or portion thereof for which such permits are valid.

Displaying of permits.

(1)

Permit holders are required to display the permit decal issued on the driver's side rear-seat window of the vehicle so that it can be clearly read from the outside of the vehicle.

(2)

Visitor permit holders are required to display the permit by hanging it on the rearview mirror of the vehicle in a manner that it can be clearly read from the outside of the vehicle.

Withdrawal of permit parking.

(1)

The Chief of Police will accept petitions for withdrawal of permit parking in a form promulgated by the Chief of Police or his designee, signed by representatives of at least 60% of property owners located in a permit parking area designated in § 349-2. Upon receipt of a qualifying petition, the Chief of Police or his designee shall conduct a study for the purpose of determining if it is not longer necessary for a designated area to have permit parking and make a recommendation to the City Council accordingly. The City Council may at any time initiate its own action to withdraw permit parking in an area, without the necessity of following these procedures.

(2)

Petitions shall be signed by one person with an ownership interest in a single-family residence or by one person with an ownership interest representing all of the tenants in a multifamily structure. The address of each petitioner must be shown.

(3)

Upon action by the City Council withdrawing permit parking in a designated area, written notice of such action shall be sent to each holder of a parking permit in that area.

§ 349-2 Restricted streets.

Pursuant to the provisions of § 349-1 of this article and based upon the findings of the Chief of Police, or his designee, made in accordance therewith, no person who does not hold a parking permit issued in accordance with the terms of this article shall park any vehicle on the following described streets or portions thereof in the City of Clifton between the hours and on the days indicated: [Amended 9-5-2006 by Ord. § 349-3 Application for permit; fee.

Application for parking permits under this article shall be made in writing to the Chief of Police, or his designee, upon such forms as may be provided.

An applicant for a parking permit under this article shall show to the Chief of Police, or his designee, satisfactory evidence that he fulfills all the conditions required for the issuance of such permit. Whenever such conditions no longer exist, any person holding such permit shall surrender the same to the Chief of Police, or his designee. It shall be unlawful for any person to represent that he is entitled to a permit under this article when he is not so entitled, to fail to surrender a permit to which he is no longer entitled, or to park a vehicle displaying such permit at any time when the holder of such permit is not entitled to hold it.

The fee for each parking permit granted under § 349-1 shall be $10 for two calendar years. Each visitor parking permit granted under § 349-1B(2) shall be $10 for two calendar years.

§ 349-5 Designation of restricted municipal lots; issuance of permits.

Parking shall be prohibited in the municipal lots set forth herein, except by permit as hereinafter provided, during the hours set forth herein.

The Chief of Police shall cause appropriate signs to be posted in such municipal lots prohibiting all parking thereon during the hours set forth herein, except parking by holders of permits to be granted only under the following terms and conditions:

(1)

In the case of Municipal Lots 1, 2, 3, 4, and 5, to every vehicle owned or leased by residents and merchants located within the Historic Botany Special Improvement District, or located on any of the following streets:

Randolph Avenue (Highland to Clifton Avenue),

Highland Avenue (Randolph to Hope Avenue),

Center Avenue (Hope to Parker Avenue),

Harrison Place (Center to Parker Avenue),

Ackerman Avenue (Harrison Place to Cheever Avenue),

Lake Avenue (Hope to Randolph Avenue),

Lincoln Place (All),

Exchange Place (All),

James Street (All),

Durant Avenue (All),

Dayton Avenue (All),

Parker Avenue (All),

Winser Street (All),

Davidson Street (All),

VanWinkle Avenue (All), and

Cheever Avenue (All);

that is registered in the State of New Jersey, and up to one vehicle owned or leased by one overnight visitor per resident for up to seven consecutive days.

§ 349-6 Restricted municipal lots.

No person who does not hold a parking permit issued in accordance with the terms of this article shall park any vehicle in the following described municipal lots or portions thereof in the City of Clifton between the hours and on the days indicated:

§ 349-7 Application for permit; fee; term of permits.

Whenever such conditions no longer exist, any person holding such permit shall surrender the same to the Chief of Police, or his designee. It shall be unlawful for any person to represent that he is entitled to a permit hereunder when he is not so entitled, to fail to surrender a permit to which he is no longer entitled or to park a vehicle displaying such permit at any time when the holder of such permit is not entitled to hold it.

The fee for each parking permit granted under this article shall be $5. Each parking permit granted under this article shall remain valid during the ownership period of such vehicle by the applicant. Each visitor parking permit granted shall remain valid during the residency of the applicant up to a maximum of seven days.
