Parking in the nonmetered municipal parking lot on the Municipal Complex fronting on Chestnut Street and West Third Avenue is restricted to municipal employees and official vehicles which have spaces designated therein. Vehicles so parked shall be properly identified. Any violations of this provision are subject to the penalties as set forth in § 523-4.

No person, business, or commercial entity shall park any motor vehicle on the public streets or highways of the Borough for the purpose of advertising or exhibiting the vehicle or other items for sale. Notwithstanding the foregoing, nothing herein shall prohibit a person, business, or commercial entity from displaying a business or trade name on a vehicle parked on the public streets or highways of the Borough, nor prohibit a person who is not regularly engaged in the business of the sale of used or new vehicles, from advertising a motor vehicle owned and titled to such person as for sale by owner from parking said motor vehicle on the public streets or highways of the Borough. Any violations of this provision are subject to the penalties as set forth in § 523-4.

The provisions of this article shall be applicable to all permit parking areas in municipal parking lots described in Schedule XXVI (§ 523-135). These regulations shall be deemed to be in addition to any special regulations provided for in any individual parking lot.

A. 
If any vehicle is parked in a parking space herein provided for in violation of the provisions of this chapter, the Police Department may cause any such vehicle to be removed to such a place as is designated by the Chief of Police. The owner or operator of any vehicle so removed shall pay the reasonable cost and expense of such removal and storage which may result.
B. 
Permit parking is established in the municipal lots described in Schedule XXVI (§ 523-135) as indicated in this article. The Police Department is hereby authorized to issue persons applying therefor, on payment of the required fees, on a first-come-first-served basis, permits for the parking of motor vehicles in the parking spaces. Said permits shall be issued on a quarterly basis for the period of three months, commencing January 1, April 1, July 1 and October 1 of each year, and each permit shall authorize the person to whom it has been issued to park a designated motor vehicle at a designated space provided in the Borough during the hours when vehicles may be legally parked in said space. The right to renew shall be subject to payment within five days of the due date. Failure to comply will result in the leasing of the permit to the next available applicant.
C. 
The fee for obtaining one parking permit shall be as described in Schedule XXVI (§ 523-135) payable in advance.
D. 
At the time of the issuance of each permit, the Police Department shall also issue to the person to whom the permit is granted a sticker containing the registration number of the motor vehicle for which the permit was issued and the permit number and the expiration date of said permit designated by the Quarter No. 1, 2, 3 or 4. Each person to whom a parking sticker is issued shall display same in the lower right corner of the inside of the rear window of the motor vehicle for which the permit was issued in such a manner as to be clearly visible to any officer enforcing parking regulations.
E. 
If any vehicle is parked in any permit parking space without the necessary permit as indicated aforementioned in violation of the provisions of this article, the Police Department may cause any such vehicle to be removed to such a place as is designated by the Chief of Police. The owner or operator of any vehicle so removed shall pay the reasonable cost and expense of such removal and storage which may result. Any violations of this provision are subject to the penalties as set forth in § 523-4.

No vehicle shall be parked or stopped adjacent to any space in a preferential parking zone described in Schedule XXVII (§ 523-136) attached to and made a part of this chapter. Any violations of this provision are subject to the penalties as set forth in § 523-4.

A. 
Except as provided for in § 523-25A, it shall be unlawful for any person to sell, rent, transfer or lease or cause to be sold, rented, transferred or leased for any value or consideration or no value or consideration any preferential parking permit. Upon conviction of a violation of this subsection, all preferential permits issued to or for the benefit of the unit for which the sold, rented, transferred or leased permit was authorized shall be void and shall be returned to the Police Department.
B. 
It shall be unlawful for any person to buy or otherwise acquire for value or otherwise use any preferential parking permit, except as provided for in this chapter.

A. 
The Police Department shall issue four permits for preferential parking. The permits shall be issued to the owner of Block 3101, Lot 34. The owner, in his sole discretion, will designate the holder of the permit. The owner shall provide the Police Department with the name of the holder of the permit and the make, model and license plate of the owner of the vehicle.
B. 
Applications for preferential parking permits under this article shall be made in writing on forms provided by the Police Department.
C. 
Duration of permits. Permits issued pursuant to this section shall remain effective from January 1 to December 30 of the year following the date of issuance, or fraction thereof, or as long as the applicant continues to own Block 3101, Lot 34, or until the preferential parking zone for which such permit was issued is eliminated, whichever period of time is less. Renewals for any permits shall be applied for and issued during the month of December preceding the period for which a renewal is sought. Each renewal shall be subject to the same conditions and restrictions as any new application. Permits are nontransferable except as provided heretofore.
D. 
The permit shall be returned to the Police Department upon sale, junking or other transfer of a vehicle. Permits shall be surrendered to the Police Department when moving outside the permit parking area. New permits will be issued if a substitute vehicle is purchased or leased.
E. 
Conditions of permits. Each permit issued shall be subject to all the conditions and restrictions set forth in this chapter and of the preferential parking zone for which it was issued, including conditions and restrictions which may be altered or amended from time to time. The issuance of such permit shall not be construed to be a permit for, or approval to, violate any provision of this chapter or any other laws or regulations.
F. 
All permits shall be displayed on the lower right corner of the inside of the rear window of the vehicle in such a manner as to be clearly visible to any officer enforcing parking regulations.
G. 
There will not be any application fee required to obtain any permit.

No person shall park a vehicle at any time upon any of the streets or parts there of which are described in Schedule XII (§ 523-122), attached to and made a part of this chapter. Any violations of this provision are subject to the penalties as set forth in § 523-4.

No person shall stop or stand a vehicle upon any of the streets described in Schedule XIII (§ 523-123), attached to and made a part of this chapter. Any violations of this provision are subject to the penalties as set forth in § 523-4.

A. 
No person shall park any vehicles other than passenger automobiles upon any street within the Borough of Roselle. Vehicles specifically prohibited under this section shall include, but not be limited to, the following:
(1) 
Trucks over four tons gross weight;
(2) 
Buses of any type;
(3) 
Truck tractors;
(4) 
Trailers;
(5) 
Semitrailers;
(6) 
Recreation vehicles;
(7) 
Boats or other watercraft;
(8) 
Vehicles of any type with commercial license plates or markings; and
(9) 
Vehicles of any type loaded or equipped in a manner that would lead a reasonable observer to believe that same was being used for commercial purposes.
B. 
Exceptions.
(1) 
Vehicles other than passenger automobiles may park on streets within the Borough of Roselle between the hours of 6:00 a.m. and 7:00 p.m. for the pickup and delivery of material; while actively loading and unloading; or while the driver is providing a service or commodity to a residence, business, or commercial facility when such vehicles are being used for work in connection with the furnishing or supplying of the service or commodity.
(2) 
The provisions of this section shall not apply to authorized emergency vehicles.
(3) 
The provisions of this section shall not apply to vehicles owned by a public utility as defined in N.J.S.A. 48:2-13 when such vehicles are being used for work in connection with the furnishing or supplying of the commodity which by law the public utility is authorized to furnish or supply.
C. 
Proper signs shall be erected by the Police Department pursuant to law (N.J.S.A. 39:4-198).
D. 
Violations and penalties.
(1) 
Any person, association or corporation who shall violate the provisions of this section shall, upon conviction, be subject to the penalties as set forth in § 523-4.

No person shall park a vehicle between the hours specified in Schedule XV (§ 523-124) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XV, attached to and made a part of this chapter. Any violations of this provision are subject to the penalties as set forth in § 523-4.

No person shall stop a vehicle during the times specified in Schedule XVI (§ 523-125) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVI, attached to and made part of this chapter. No person shall stand a vehicle during the times specified in Schedule XVII (§ 523-126) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVII, attached to and made a part of this chapter. Any violations of this provision are subject to the penalties as set forth in § 523-4.

No person shall park a vehicle for longer than the time limit shown in Schedule XVIII (§ 523-127) at any time between the hours listed in said Schedule XVIII of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVIII, attached to and made a part of this chapter. Any violations of this provision are subject to the penalties as set forth in § 523-4.

No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XIX (§ 523-128), attached to and made part of this chapter, except at the angle designated and only within the painted stall lines. On all streets and portions thereof where angle parking is now or shall hereafter be authorized, all vehicles parked thereon shall be parked with the front thereof nearest the curb. Any violations of this provision are subject to the penalties as set forth in § 523-4.

The locations described in Schedule XX (§ 523-129), attached to and made a part of this chapter, are hereby designated as loading zones. No person shall park a vehicle in said locations other than for the loading or unloading of goods and materials. Any violations of this provision are subject to the penalties as set forth in § 523-4.

The locations described in Schedule XXI (§ 523-130), attached to and made a part of this chapter, are hereby designated as taxi stands. Any violations of this provision are subject to the penalties as set forth in § 523-4.

The locations described in Schedule XXII (§ 523-131), attached to and made a part of this chapter, are hereby designated as bus stops. No person shall park, stop, or stand a vehicle in said locations other than a bus actively picking up or discharging passengers. Any violations of this provision are subject to the penalties as set forth in § 523-4.

A. 
The locations described in Schedule XXIXA (§ 523-138A), attached to and made a part of this chapter, are hereby designated as restricted parking spaces reserved for use by handicapped persons, pursuant to N.J.S.A. 39:4-197.5.
B. 
The locations described in Schedule XXIXB (§ 523-138B), attached to and made a part of this chapter, are hereby designated as restricted parking spaces reserved for use by a specific person in front of a certain residence, pursuant to N.J.S.A. 39:4-197.6.
C. 
The restricted handicap parking spaces described in Schedule XXIXA and Schedule XXIXB shall be reserved for use by handicapped persons who have been issued special vehicle identification cards by the Motor Vehicle Commission, pursuant to the provisions of N.J.S.A. 39:4-205, when using a motor vehicle on which is displayed a certificate for which a special vehicle identification card has been issued, pursuant to N.J.S.A. 39:4-206. All spaces indicated hereby shall be painted and signed in accordance with the applicable regulations issued from time to time by the State of New Jersey Department of Transportation.
D. 
Application; fees; approval; term and renewal.
(1) 
Persons seeking a dedicated handicap parking space under § 523-38B shall complete an application on forms provided by the Police Department and must possess a valid special vehicle identification card and show proof of residency at the requested location.
(2) 
Fees for application review shall be paid as described in § 55-15. If the application is approved, further fees for the cost of signage installation shall be paid as described in § 55-16. There shall be no fee required for renewal per § 523-38D(4).
(3) 
In completing its investigation and review, the Police Department shall only recommend approval if there is no on-site parking available and shall specify the recommended placement of signage. The Mayor and Council shall maintain final approval authority, which shall be effectuated by amendment of Schedule XXIXB (§ 523-138B). Under no circumstances shall a restricted handicap parking space be recommended or placed in any location where parking is otherwise prohibited.
(4) 
Restricted handicap parking spaces authorized under § 523-38B shall be valid January 1 to December 31. In December of each year, applicants shall be required to submit a renewal form with updated proof of residency, proof of a valid special vehicle identification card, and such other information as may be required by the Police Department. If not received by December 31, the Police Department shall send a certified letter to the applicant requesting the renewal form and notifying them of the potential removal of the dedicated handicap parking space. Denial of said renewal by the Police Department or failure to submit for renewal by March 31 of any year may result in the removal of the space from Schedule XXIXB (§ 523-138B) and the removal of associated signage.
E. 
Change in residence.
(1) 
If any person for whom a parking space has been designated pursuant to this section ceases to reside at the specified resident address, he or she shall promptly notify the Borough Clerk in writing that the designated parking space is no longer required.
(2) 
In the event that the person holding the designated handicapped parking permit no longer resides at the specified residence address, the designation may be terminated by ordinance.
F. 
Violations and penalties.
(1) 
Any person parking a motor vehicle in a parking space restricted for use to persons who have been issued special vehicle identification cards or wheelchair symbol license plates by the Motor Vehicle Commission without such a special vehicle identification card or wheelchair symbol license plate shall be liable to a fine of $250 for the first offense and, for subsequent offenses, a fine of at least $250 and up to 90 days' community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.
(2) 
This penalty provision shall apply to vehicles parked on public or private property.
