a. 
It shall be lawful for any person acting under and by the authority of the City of Linden Board of Health to enter into and upon any commercial premises within the City in the exercise of the powers or in the fulfillment of its or their duties conferred or imposed by law or City or Board ordinance and the rules and regulations thereunder.
b. 
Any person hindering, obstructing, delaying, resisting, preventing, or interfering with such right of access shall be deemed to violate the provisions of this article.
a. 
All licenses and permits issued by the Board of Health, or the Health Officer or their designee, shall be prominently displayed upon the premises for which they were issued.
b. 
All license cards or signs issued by the Board of Health, or the Health Officer or their designee, shall be displayed at all times and in plain sight of the public near the entrance in the establishment or upon the vehicle or device for which they were issued.
c. 
No license or permit issued by the Board of Health, or the Health Officer or their designee, shall be transferable from any entity or location to any other entity or location unless such transfer is authorized by law or by ordinance.
Any license or permit issued by the Health Officer or the Department of Health may be revoked for violation of the terms, conditions and provisions of the ordinance under which the said license or permit was issued or for other good cause, after hearing by the Health Officer on reasonable notice to the licensee of the time and place of said hearing unless the provisions of law or other provisions of this chapter or other ordinances provide otherwise. Pending such hearing, the Department of Health or the Health Officer may suspend such license or permit, provided that such hearing shall be brought within 10 days from the date of suspension, unless the provisions of law or other provisions of this chapter or other ordinances provide otherwise.
This chapter shall be enforced by the Health Officer or their designee, or by the City of Linden Police Department.
a. 
Each day that a violation occurs constitutes a separate and unique violation.
b. 
Any person found to be in violation of the provisions of this chapter shall be subjected to a fine of not less than $50 and not more than $2,000.
a. 
If any provision or portion of a provision of this chapter is held to be unconstitutional, preempted by federal or state law, or otherwise invalid by any court of competent jurisdiction, the remaining provisions of the ordinance shall not be invalidated.
b. 
All ordinances or parts of ordinances, which are inconsistent with any provisions of this chapter, are hereby repealed as to the extent of such inconsistencies.
c. 
No provision of this chapter shall be construed to impair any common law or statutory cause of action, or legal remedy there from, of any person for injury or damage arising from any violation of this chapter or from other law.
This chapter shall take effect upon final passage in accordance with law.
