[Adopted as Ch. V, Sec. 5-13, of the 1989 Revised General Ordinances; amended in its entirety at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]
As used in this article the following terms shall have the meanings set forth:
BULK TRASH
Refuse and garbage that, due to its size, cannot fit into a standard refuse receptacle, such as dressers, mattresses, recliners, refrigerators, dryers, and other similar large items, except for items that can be recycled.
GARBAGE
Waste or decayed animal and/or vegetable matter that has been used as food or was intended to be used as food, and the waste therefrom, and dead animal or plant life or parts of the same.
OCCUPANT
The occupant, owner, agent, tenant, lessee, caretaker or other persons or corporation in charge of a dwelling or other premises affected by this chapter.
REFUSE
Garbage and rubbish, as separately defined herein.
RUBBISH
All broken crockery, glassware, furniture, household receptacles and utensils, house sweepings, bottles, tin cans, lawn cuttings, hedge trimmings, garden growth, old clothing and all discarded and waste material of every nature and description not elsewhere defined.
A. 
Receptacles required. The occupant of any building or premises covered by the provisions of this article shall place, keep and make readily accessible, for collection and removal of garbage, refuse, and rubbish, suitable receptacles for such purpose in accordance with the provisions of this section.
B. 
Types of receptacles. Receptacles shall be made of durable material, shall be watertight, and provided with suitable handles and a tightfitting cover that will prevent access of flies and other insects to the contents. The same shall be covered at all times and shall have a capacity of not more than 48 gallons. All garbage must be wrapped in heavy bags or paper and placed in the refuse receptacles.
C. 
Receptacle limit. No more than six receptacles per household shall be placed curbside for collection. Receptacles shall not weigh more than 40 pounds each.
D. 
Placement and removal of receptacles.
(1) 
When not set at the curb for pickup, all refuse receptacles shall be kept to the rear of the front building setback line or the front of existing structures on a lot (whichever is closer to the street).
(a) 
Receptacles shall be stored:
[1] 
In a location not visible from a public street;
[2] 
In a location screened from view from the public street by plantings, fencing, or an enclosure; or
[3] 
Inside a garage, shed, or other structure.
(b) 
In addition, receptacles shall be stored in proper containers as set forth in Subsection B, above, and shall be protected from vermin, animals, or other conditions that may cause the contents of the receptacle to be spilled or scattered. The occupant shall keep receptacles clean and in a condition for safe handling.
(2) 
No material or receptacles shall be placed at the curb for collection earlier than 3:00 p.m. of the day preceding the nearest collection day. Emptied receptacles shall be removed no later than 9:00 p.m. on the day of collection.
E. 
Size. No item placed curbside for collection shall be greater than four feet in length, except for bulk trash in Subsection F below.
F. 
Bulk trash. Bulk items may be placed curbside during the normal collection schedule. Bulk trash placed curbside shall be limited to two items per collection cycle. Refrigerators, large trunks, washing machines, dryers, and other similar large items shall have all doors and lids removed prior to collection.
G. 
Carpet disposal. Carpet shall be rolled and safety secured in sections of not longer than three feet in length nor more than 30 pounds. Only one roll of carpet at a time can be placed curbside for collection.
H. 
Waste resulting from building construction or alteration work shall be removed as soon as possible by the owner of the premises or the contractor performing such work. Construction waste shall not be placed curbside for collection.
I. 
Hazardous material shall not be placed in a container or set out for collection either by itself or in conjunction with any other material. Residents are required to call the Burlington County Hazardous Waste Facility for proper disposal of hazardous materials.
J. 
House/rental cleanouts. Excessive garbage, refuse, rubbish, or bulk trash placed curbside as the result of a house/rental cleanout will not be collected. Property owners shall be responsible for procuring a dumpster for such cleanouts.
No person or occupant shall burn any garbage, rubbish, refuse, or dead matter except in accordance with adopted fire code regulations.[1]

Any person found in violation of any of the provisions of this article shall, upon conviction, be sentenced in accordance with the provisions of § 1-14, General penalty, of the Code of the City of Beverly.
