Each driver in a funeral or other procession shall drive as near to the right-hand edge of the roadway as practical and shall follow the vehicle ahead as close as is practical and safe.

No driver of a vehicle shall drive between the vehicles comprising a funeral or other authorized procession while they are in motion and when such vehicles are conspicuously identified. This provision shall not apply at intersections where traffic is controlled by traffic-control signals or police officers.

(a) 
Definitions.
The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Golf Cart.
A motor vehicle designed by the manufacturer primarily for use on a golf course or as defined by section 551.401, Texas Transportation Code, as it now reads or as it may be amended.
Public Street.
A publicly owned or dedicated road, street, drive, recreation lane, path or other right-of-way for the use of golf carts within the municipal limits of the City of Brownfield that is not designated as part of either the state or federal highway system.
(b) 
General Prohibition and Exceptions.
(1) 
Prohibition.
Except as otherwise provided for in this section, the city council finds that, in the interest of safety, the use of golf carts on public streets is prohibited.
(2) 
Public Safety Exception.
This section does not apply to the operation of a golf cart that is owned by the state, a county, or a municipality and used to maintain public safety and by a person who is an authorized operator of the golf cart.
(3) 
Commercial Repair Exception.
This section does not apply to the operation of a golf cart by the owner or employee of a commercial business that repairs golf carts so long as such operation of the golf cart is solely and exclusively related to the repair of the golf cart and operated within one (1) mile of such commercial business.
(c) 
Operation and Use of Golf Carts.
(1) 
Use Public Streets.
A person may operate a golf cart on a public street within the city subject to the following terms and conditions:
(A) 
The golf cart may only be operated on a public street for which the posted speed limit is not more than 35 miles per hour;
(B) 
A golf cart may cross a street at an intersection, including an intersection with a street that has a posted speed limit of more than 35 miles per hour but only for so long as is necessary to cross such street;
(C) 
The golf cart may not be operated on any public sidewalks, shared-use paths under eight feet (8') in width, pedestrian walkways, trails, playgrounds, greenbelts, or other public recreational areas not designated for motor vehicle traffic, except in designated areas with appropriate signage clearly allowing for the use of golf carts;
(D) 
While in use, the golf cart is not more than five miles from the location where the golf cart is usually stored or parked;
(E) 
Any person operating the golf cart is in compliance with the general operator requirements found in subsection (c)(3);
(F) 
The golf cart may not be used to pull trailers, boats, jet skis, another vehicle or any other object or person;
(G) 
The golf cart displays a valid license plate issued by the Texas Department of Motor Vehicles for such golf cart; and
(H) 
The golf cart is not being operated on any of the following municipal streets or highways:
(i) 
North and South Cedar Street.
(ii) 
North and South "D" Street.
(iii) 
"B" Street south of Tahoka Highway (U.S. Hwy 380)
(iv) 
Ballard Street north of Tahoka Highway (U.S. Hwy 380).
(v) 
Cub Drive north of Tahoka Highway (U.S. Hwy 380).
(vi) 
100 Block to 900 Block of East Felt Street.
(vii) 
100 Block to 1200 Block of East Bynum.
(viii) 
100 Block to 900 Block of East Lanny.
(ix) 
Old Lamesa Road.
(x) 
100 Block to 800 Block of West Broadway.
(xi) 
100 Block to 900 Block of West Main.
(xii) 
900 Block to 1300 Block of East Grace.
(xiii) 
1300 Block to 1700 East Webb Street.
(2) 
Required Golf Cart Equipment.
All golf carts operated on a public street within the city under this section must have the following equipment:
(A) 
Headlamps;
(B) 
Taillamps;
(C) 
Reflectors;
(D) 
Parking brake; and
(E) 
Mirrors.
(3) 
General Operator Requirements.
In addition to any requirements found elsewhere in this section, any person operating a golf cart under this section must:
(A) 
Have a valid driver's license;
(B) 
Maintain current financial responsibility as required by state law that covers the golf cart;
(C) 
While the golf cart is in motion, the driver and every passenger in or on the golf cart is seated in a seat designed to hold passengers;
(D) 
Not allow any person to stand or ride in the lap of the driver and/or other passenger of a golf cart while it is moving or allow for more passengers than the golf cart was designed to carry;
(E) 
Must move to the right and yield the right-of-way to faster moving vehicles;
(F) 
Must remain in the outside lane of a multi-lane public street unless turning left off of the public street;
(G) 
Only operate the golf cart during the daytime; and
(H) 
Comply with all applicable federal, state and local laws and ordinances including all applicable rules of the road as required by the Texas Transportation Code.
(d) 
Penalty.
Any violation of this section by any person shall constitute a misdemeanor and shall be punishable by a fine not to exceed $500.00. Each day any violation of this code or of any ordinance shall continue shall constitute a separate offense. This penalty provision shall be in addition to any other legal or equitable remedies available to the city to enforce this article.

(a) 
It shall be unlawful for the operator of any motor vehicle to engage in an exhibition of acceleration.
(b) 
As used herein, the term "exhibition of acceleration" includes either:
(1) 
Proceeding from a stopped position at a rate of acceleration that constitutes an unreasonable risk that the operator could lose control of the vehicle; or
(2) 
While a motor vehicle is in motion, suddenly accelerating at a rate that could cause the operator to lose control of the vehicle. While the operator is not participating in a drag race or contest of speed or acceleration.
