This article establishes a retirement plan for the non-uniformed employees of the Township of Spring, through the adoption of the Township of Spring Non-Uniformed Employees Retirement Income Plan, originally effective September 1, 1970, as amended and restated effective January 1, 2026, closing participation to the Defined Benefit portion of the Pension Plan for all non-uniformed employees hired after December 31, 2025, and providing a Defined Contribution Benefit in Pension Plan for all non-uniformed employees hired after December 31, 2025 a copy of which Amended Pension Plan is attached hereto.[1]

If any sentence, clause, section, article or part of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections, articles or parts of this article. It is hereby declared as the intent of the Board of Supervisors of the Township that this article would have been adopted had such unconstitutional illegal or invalid sentence, clause section, article or part thereof had not been included herein.
